NOTICE OF VIOLATION Iowa Electric Light and Power Company Docket No. 50-331 Duane Arnold Energy Center License No. DPR-49 During an NRC inspection conducted on September 7 through October 1, 1993, violations of NRC requirements were identified. In accordance with the

" General Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C, the violations are listed.below:

A. 10 CFR 50, Appendix B, Criterion XVI, " Corrective Action," states, in part, that conditions adverse to quality, such as failures, malfunctions, deficiencies, deviations, defective material and equipment, and nonconformances are promptly identified and corrected.

In the case of significant conditions adverse to quality, the measures shall assure that the cause of the condition is determined and corrective action taken to preclude repetition.

Contrary to the above:

1. Conditions adverse to quality were not promptly corrected when the licensee identified inoperable fire barriers between the control room and cable spreading room on September 29, 1992 (Deviation Report 92-305) and failed to take corrective action prior to the completion of the inspection on October 1, 1993.
2. Corrective actions were not taken to address the January 28, 1993, failure of the HPCI discharge check valve (V-23-049) prior to reactor startup.

B. 10 CFR Part 50, Appendix B, Criterion V requires, in part, that activities affecting quality be prescribed by and accomplished in accordance with, documented instructions, procedures, or drawings of a type appropriate to the circumstances.

1. NGD procedure 106.3, " Procedure Change, Revision and Cancellation," step 5.1 states that inconsequential changes made to correct minor errors in spelling or grammar that will enhance but in no way affect the meaning, content, or application of the document may be made using a Procedure Change Notice.

Contrary to the above:

Procedure Change Notices were routinely issued which changed the meaning, content, and application of station administrative procedures.

2. Engineering Department Procedure 1203.01, " Engineering Work Requests," step 4.3 designates the Supervising Engineer . Systems >

as the EWR Review Committee Chairman; step 6.4.1 states,-in part, the Manager, Engineering should authorize work and sign the EWR.

i Contrary to the above:

Engineering Work Requests were. routinely filled out with. improper 3 management signatures and in several cases without any management planning or authorization signatures. '

3. Administrative procedures 1406.02, Procedure Preparation, Review 1 and Approval, step 4.0.(1) states that the Plant Superintendent -  ;

. Nuclear is responsible for approving plant procedures. .

individuals. e These are identified as Severity Level IV problems (Supplement I). .

Pursuant to the provisions of 10 CFR 2.201, Iowa Electric Light and Power '

Company is hereby required to submit a written statement or explanation to the .;"

U.S. Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington D.C. 20555, with a copy to the U.S. Nuclear Regulatory Commission, Region III, 799 Roosevelt Road, Glen Ellyn, Illinois, 60137, a copy to the NRC Resident Inspector at the Duane Arnold Energy Center within 30 days of.the date of:the :i letter transmitting this Notice of Violation (Notice). This reply should be  !

clearly marked as a " Reply to a Notice of Violation" and should include for i each violation: (1) the reason for the violation or, if contested, the basis  ;

for disputing the violation, (2) the corrective steps that have been taken.and the results achieved, (3) the corrective steps that will be taken-to avoid i further violations, and (4) the date when full compliance will be achieved. 1 If an adequate reply is not received within the time specified in this Notice, an order or a demand for information may be issued as to why the license should not be modified, suspended, or revoked, or why such other action'as may be proper should not be taken. Where good cause is shown, consideration will i be given to extending the response time.
