NOTICE OF VIOLATION lES Utilities In Docket No. 50-331 Duane Amold Energy Center License No. DPR 40 During an NRC inspection conducted on November 11 through December 22,1997, a violation of NRC requirements was identified, in accordance with the ' N neral Statement of Policy and Procedure for NRC Enforcament Actions," NUREG 1600, (na violation is listed below:

Technical Specification 6.9.1 requires that procedures for personnel radiation protection shall be prepared consistent with the requirements of 10 CFR Part 20 and shall be approved, maintained and adhered to for all operations involving personnel radiation exposur Administrative Control Procedure 1411.20, * Respiratory Protection," Revision 5, implements the above requirement by requiring that each respirator wearer be fit tested within the previous 12 months plus 30 day Special Order 97-01 requires that members of certsiin job classifications such as Operating Shift Supervisors and Shift Technical Advisors, must be respirator and self-contal,ied breathing apparatus qualifie Contrary to the above, the NRC identified on December 18,1997, that three individuals designated as requiring annual rcspirator fit testing were overdue for this trainin Specifically, two operating shift supervisors were not fit tested within 14 and 15 months respectively, and c shift technical advisor was not tested within 18 month This is a Severity Level IV violation (Supplement 1).

Pursuant to the provisions of 10 CFR 2.201, Duane Amold Energy Center is hereby required to submit a written statement or explanation to the U.S. Nuclear Regulatory Commission, ATTN:

Document Control Desk, Washington D.C. 20555 with a copy to the U.S. Nuclear Regulatory Commission, Region lil,801 Warrenville Road, Lisle, Illinole 60532-4351, and a copy to the NRC Resident inspector at the Duane Amold Energy Center within 30 days of the date of the letter transmitting this Notice of Violation (hc This reply should be clearly marked as a " Reply to a Notice of Violation" and should include for each violation: (1) the reason for the violation, or, if contested, the basis for disputing the violation, (2) the corrective steps that have been taken and the results achieved, (3) the corrective steps that will be taken to avoid further violations, and (4) the date when full complir.nce wi'! be achieved. Your response may reference or include previously docketed correspondence, if the correspondence adequately addresses the required response. If an adequate reply is not received within the time specified in this Notice, an order or a Demand for Information may be issued as to why the license should not t's modified, suspended, or revoked, or why such other action as may be proper should not be taken.
