Dear Mr. Eisenhut:

Offshore Power Systems does not believe itself to be a " licensee" as used to address Generic Letter 83-10d, dated February 8, 1983. Rather, we are more properly ,

equivalent to a construction permit holder. We are  ;

therefore uncertain as to whether a response to Generic Letter 83-10d is required, but none-the-less offer the following:

The resolution of TMI Action Item II.K.3.5 will be initiated when and if (1) a customer for the first FNP is attained and (2) final design efforts are begun. These events cannot be meaningfully scheduled at this time.
