In view of the Applicant's letter advice to the Board on November 9,1978 and the Board Order of November 22, 1978, the Applicant and the Staff have continued discussion of differences regarding the Applicant's Motion to Plead a Matter in Con-troversy, et al.

Agreement in principle has been reached in a number of areas constituting the bases of the Applicant's original filing. While the agreement is substantial, it is not complete and there will be a few are6s re-maining for Board resolution. Both the Applicant and the Staff believe it would be helpful to the Board to receive revised language documenting the areas of agreement which the Applicant plans to file the week of December 11, 1978, after receipt of comments from the Staff. As a consequence, the Applicant believes that the number of differences to be resolved by the Board will be considerably reduced and urges the Board to defer ruling until after receipt of the revised language.
