Speck O Associate Director, State ' - " and Local Programs and Support Federal Emergency Management Agency Nashington, D.C. 20472 Re: Shoreham Emergency Planning near Mr. Speck: I.have had an opportun_ity_to review your._Octgber_ _____, 29, 1985 letter to Mr. Milliam Dircks concerning FEMA's proposal to schedule an exercise of Revision 5 of LILCO's emergency plan. As the chief elected of ficial in the Town of Southampton, whose 50,000 residents reside immediately outside LILCn's ten mile emergency planning zone on Long Island's south fork, I take strong exception to your proposed exercise and request that your proposal immediately be withdrawn. Your effort to schedule an exercise without participation hy State and local officials smacks of a conspiracy to impose an emergency plan on the residents of Suffolk County. It is a waste of the taxpayers' money and it flies directly in the f ace of assurances given by President Reagan that the sovereignty of State and local officials over emergency planning for Shoreham would he respected. As you must know, LILCO's emergency plan has repeatedly been declared unlawful under the laws of the State of New York. Furthermore, it has been deemed legally insufficient to support the issuance of an operating license by the Licensing and Appeal Boards of the Nuclear Rogulatory Commission. Each of these tribunals has been unequivocal in rejecting LILCO's pla n. Finally, the highest Court in the State of New York has upheld the emergency planning determinations made by the Suffolk County Legislature, which declined to adopt or implement an emergency plan for Shoreham. Speck-l November 12, 1985 l Page 2 Your October 29th letter seems to recognize these j obvious facts since you state: i "Any exercise without participation by State and local governments would not allow us [ PEM Al l sufficient demonstration to reach a finding of L reasonable assu ra nce. " Under the Memorandum of Understanding with the NRC, FEMA's role is to make findings of fact that can be productively utilitzed in NRC licensing proceedings. Since the NRC has repeatedly determined that LILCO's emergency plan;does not meet NRC regulations and since you have concluded that your proposed exercise will not provide a basis for a finding of reasonable assurance, your proposed exercise is nothing but a waste of time and taxpayers dollars. You would better serve the

public and would be more faithful to the policy determinations of the President if you invested FEMA's limited resources in useful endeavors rather than doing the bidding of a private' corporation.

The Town of Southampton strongly supports the emergency planning determinations made by the Suf folk County Legislature. We intend to take whatever action is necessary in order to prevent the imposition of a. utility plan on residents of our community by your agency or by anyone else. I strongly urge you to reevaluate your misguided proposal to conduct an
