Dear Mr. Brown:

Your letter, dated October 29, 1986, to David McLoughlin, Deputy Associate Director, Federal Baergency Management Agency, has been referred to me for l reply. It concerns Mr. McLoughlin's memorandum of October 6,1986, to Norman Steinlauf, Acting Regional Director, FEMA Region II. Counsel for FEMA had caused the memorandum to be served on all parties in the Shoreham OL-3 and j OL-5 proceedings for their information.

Please be advised that we have no intention of withdrawing that part of the memorandum to the region to which you object, i.e., that in performing its review of Revisions 7 and 8 of the LILCO Transition Plan the Regional Assistance Committee (RAC) may have had to assume, pending final resolution of the issue in the courts, that the authority necessary to manage and implement the offsite plan exists.

In passing, as FEMA is represented by counsel in the Shoreham litigation, it is requested that future correspondence of this nature la addressed to that counsel or to me.
