Sense of the Legislature urging the rejection of LILCO's  ;

request to operate the Snoceham Nuclear Power Pir.nt at '

twenty-five percent power WiiEREAS, the Nuclear Regulatory Commission has been considering a request from the Long Island f.ighting Company (LILCO) since April of 19P for permission to operate the Shorehar. Nuclear Power Plant at twenty-five percent pt vers and i WilEREAS, The Suf folk County Legislature and the State of New 'ork, among others, have long been on record as opposing the operation of this plant at any level i of power, based on the fact that it would be impossible to safely evacuate the public, l or otherwise ensure the health and safety of the public, in the event of an accident '

at the plant; and WHEREAS, in support of LILCO's request, the staff of the NRC has issued a report  !

stating that operation at twenty-five percent would not pose any additional safety threats: and WHEREAS. such a determination clearly neglects the fact that any type of nuclear f accident at the plant would greatly jeopardize the health and safety of Suffolk County  ;

residents due to the uniqueness of Long Island's geography and the lack of an approved emergency evacuation plan formulated with the cooperation of State and County l officials and l

WHEREAS, United States Energy Secreta. ' John Herrington has urged the NRC l to "move expeditiously" on the licensing of the b oreham plant: and i WHEREAS, such actions illustrate yet another attempt by federal governmental f authorities to quickly force the Shoreham plant upon the people of Suffolk County '

regardless of the health and safety threats now, therefore, be it RESOLVED, that Suffolk County opposes any attempt by the NRC to grant the Long Island Lighting Company a license for the operation of Shoreham at twenty-five percent powers and be it further, RESOLVED, that Suffolk County urges the NRC to reject the findings in its staff report that the operation of Shoreham at twenty-five percent power would not pose any new safety problems: and, be it further, RESOL \ ED, that a copy of this resolution shall be sent to the NRC commissioners, the United States Senators from New York, and the Long Island Congressional delegation.
