York, we request, pursuant to the Freedom of Information Act, as amended, 5 U.S.C. 5 552 ("FOIA"), and the rules of the Federal Emergency Management Agency {"FEMA") issued thereunder, 44 C.F.R.

Part 5, copies of all agency records, including any notes, minutes, comments, and/or transcripts in the possession or control of the FEMA relating to:

1. any meetings of the Federal Radiological Preparedness Coordinating Committee ("PRPCC") held during the period September 1, 1986 to the present, including the special meeting of the FRPCC held on December 11, 1987;
2. any meetings of the FEMA /NRC Steering Committee held in the period September 1', 1986 to the present, including a meeting held on. December 8, 1987;
3. FEMA's emergency plan reviews or FEMA's conduct of emergency plan exercises under the revised NRC emergency planning rule set forth in 52 Fed Reg., 42078 (1987);
4. a December 7, 1987 NRC Licensing Board decision in the Shoreham case (LBP-87-32);

6. the December 15, 1987 FEMA "Fact Sheet to Accompany NRC-FEMA Guiding Document: Criteria For Utility Offsite Planning and Preparedness (Nureg-06S4/PEMA-Rep-1, Rev. 1, Supplement 1 ) .

In the event that access is denied to any of the records responsive to this request, please supply the following information:

a. Identify the record or withheld portion of the record and specify the statutory basis for the denial, as well as your reason for believing that an exemption applies, as required by 44 C.F.R. 5 5.54(b).
b. Segregate the nonexempt from the allegedly exempt portion of any withheld records and release the former, as requircd by 44 C.F.R. 5 5.71
c. Supp2.y a detailed statement of the content of the withheld document or portion thereof, along with the date on which that document or portion thereof was written; its section heading or title; and an identification of any persons or entities who have received copies of such records or portions thereof, as required by applicable case law. Vaughn v. Rosen, 484 F.2d 820, 826-827 (D.C. Cir. 1973).
d. Separately state your reasons for not invoking your discretionary power to release the allegedly exempt records or portions thereof.

The undersigned will pay charges for search time and copying fees, as provided by FEMA regulations, 44 C.F.R. 5 5.46. National System for Emergency Coordination. (4 pages)

This document was distributed to attendses at one of the FRPCC meetings.

It does not relate directly to nuclear offsite planning and preparedness which we assume to be your main interest. Rather, it relates to a proposed national system for ensuring that Federal action is organised and coordinated in the event of an extreme catastrophic domestic disaster.

Although we do not believe that this draf t is directly responsive to your request, we did consult with the Domestic Policy Council to determine if it could be released under the FOIA. The Domestic Policy Council informed our Agency that the draf t document is considered part of the Presidential policy process and, therefore, subject to Executive Privilege under exemption (b)(5) of the EVIA. Consegunntly, this document is withheld in its entirety.

This draf t was prepared by one of the Office of General Counsel attorneys responsible for providing legal advice on any issues raised by the NRC Licensing Board decision. This document is protected under the attorney work product privilege of exemption (b)(5).

1 According to the Department of Justice guidance dated June 6,1979, the purpose of exemption (b)(5) is to assure

The exemption is designed to encourage f ree and f rank discussions of innovative or controversial ideas and to protect the advisory and deliberative process of government agencies, therdar assuring an effective decisionmaking process.

In searching our files, we located a number of documents prepared by other Federal agencies. They have been referred to the appropriate agency for review, determination of disclosure, and direct response to you. See enclosed letters to the Nuclear Regulatory Commission, Department of Navy, Department of Transportation, and Environmental Protection Agency for a description of the specific documents referred to their respective agency.
