I am writing on behalf of the Citizens Awareness Network (CAN) of Shelburne Falls, Massachusetts and its standing request to be placed on the Service List for the Vermont Yankee NRC Docket.

Please find enclosed a letter I received from CAN outlining its numerous, unsuccessful attempts to be placed on the Service List.

I respectfully request your review of this matter and would appreciate any information or assistanco you could provide.

Dear Congressman Olver,

Thank you for your kind letter in which you declined attending our Peoples' Decommissioning Hearing, but stated that you would be glad to try to help us if there was anything you could do for us. We could use help in dealing with the NRC.

Back in December,1996, CAN filed a 2.200 petrtion with the NRC conceming a number of serious safety violations at Vermont Yankee Nuclear Power Station in Vemon, Vermont.

As you know, many CAN members are in the ehluent pathways and evacuation zone for Vermont Yankee, The NRC accepted the petition for consideration, and wrote back to us stating that CAN would be placed on the " Service List" for the Vermont Yankee NRC docket. This would provide us with continuous doctimentation to monitor both Vermont Yankee and NRC responses to our petition issues and other safety matter of concern to CAN.

The oroblem is that, despite numerous requests that the NRC make good on its promise, and assurances that CAN was being placed on the Service List, the NRC has never done so. Would you have someone from your office plosse get the NRC to live up to its promise by immediately putting CAN on the Service List for Verment Yankee.

Dear Ms. Ketz:

By letter dated February 9, 1996, you requested that the Citizens Awareness Network (CAN) be added to the NRC's rervice list for the Vermont Yankee Hurlear Power Station (VYNPS). You stated that CAN is a pubite interest group that has members who live within the ten alle radius of VYNPS. You indicated that the Local Public Document Room (LPOR) at the Greenfleid Community College in Greenf teld Hassachusetts, was not centrally located or convenient for menibers of y1ur organization. You further stated that the lack of computer access for NUOJCS (the NRC's document search software) makes the task of document search inef f tetent and unnecessarily time consuming.

In responding to your request, I have determined that placing CAN on the service list (i.e., the NRC's anti distributton list, as there is no active service list involving VYNPS related litigation) for VYMPS would not provide CAN dor.uments from sources other than the NRC, such as the licensee. Members of CAN would sttil need to use '.he LPOR to locate such documents. The NRC staf f recentiv visited the LPDR for VYNPS which is located at the Brooks Memortal Library on Main Street in Brattleboro, Vermont. The staff found that NUDOCS could be accessed from a personal computer on the reference librarian's desk. Additionally, there are a number of ways to obtain NRC information.

I've enclosed the brochure 'A Citizen's Guide to U.S. Nuclear Regulatory Comission information' for your use. Here are a lew highlights:

e A person with a personal computer and a modem can access HUDOCS from home or office. For detailed information and instructions, call (301) 415-7230.

  • lhere also is a toll-free number for the public to call for assistance in conducting NUDOCS searches. That number is (800) 630-8081.
  • lhe Public Document Room in Washington also can help individuals searching for information. That number is (800) 397-4209.
  • The staff also will conduct HUDOCS searches and provide a member of the public with a printout free of charge.
  • Finally, a number of documents can be accessed over the Internet.

Ms. Deborah Kat: 2 Based upon the information enumerated above, I have determined that documents are readily accessible to members of the pubite through the methods mentioned above, as well as the LPDR. Considering the availability of documents through numerous means, as well as the quantity of paper, and the clerical resources needed to comply with your request, I have determined that at this time it is not practical to add CAN to the NRC's nati distribut'on It*t (or VYNPS.

Nothwithstanding this determination, I am keenly aware of the interest that members of the pubite have in the safe operation of nuclear power plants, and have therefore initiated action to revisit appilcable NRC policies and gutuance related to the distribution of correspondence. 1 hts action is intended to ensure that my actions are re gensive to the pubile's business and consistent with the 'NRC Princ ples of Good Regulation', which includes informing the public abcut regulatory processes.
