1.0 EEREQHI The purpose of this proceduro in to establish the Fitness for Duty Program at Davis-desso Nuclear Power Station (DBNPS).
2.0 APPLICADILITY/ SCOPE 2.1 Apolicability This procedure applies to personnel granted unoscorted access to the Protected Area, or ascigned to Emergency Responso organization duties in the ECC or TSC. This proceduro shull require implomunting proceduros.
?.2 Excentions This proceduro does not apply to the followings e NRC employees e Law enforcement personnel required to have access due to official business e offsito amorgency fire and medical responso personnel whilo responding on-site.
e Stato, County, and Local Officials responding to Davis-Bosso Nuclear Power Station Emergency Pacilition outside the Protected Arna.

4.2 COMPANY SUPERVISOR - Those Company employees whose principal contribution is directing the work of other employees who are subject to 10 CFR 26.
4.3 CONFIRMED POSITIVE TEST- The result of a confirmatory test that has established the presence of drugs or drug metabolites in a specimen at or above the cut-off level, and that has been deemed positive by the Medical Review Officer (MRO) after evaluation. A confirmed positive test for alcohol can be obtained as a result of a confirmation of blood alcohol levels with a second breath analysis without MRO evaluation.

6.2.5 If the suitable inquiry establishes a record of any item (s) listed in step 6.2.3, Access Control shall deny access or assignment to ERO duties pending successful completion of the following:
- a. Medical determination of fitness for duty, l
- b. Establishment of a follow-up testing program
- c. Satisfaction of time limits specified in section 6.8, Unacceptable or Illegal Drug Related l
Sanctions.

6.2.6 Upon receipt of a suitable inquiry request and a written release from the involved individual, Access Control shall provide'the information listed in 6.2.3.a-c to the requesting licensee or employer.
6.3 Chemical Testino__Reauirements 6.3.1 Chemical testing for the presence of illegal drugs shall be required:
- a. Within 60 days prior to granting of unescorted access to the Protected Area or initial assignment to ERO duties.
- b. If Protected Area access has lapsed, testing shall be required within 60 days prior to reinstatement of unescorted access,
- c. If assignment to the Emergency Response organization has been removed, testing shall be required within 60 days prior to reassignment to the Emergency Response Organization.
- d. On a random basis at a rate equal to at least 100 percent of the workforce per year.

6.5.7 When alcohol related for-cause testing is required ,
and the Health Center is unavailable, the Supervisor-Security Shift shall ensure a breath alcohol analysis is performed.

.039, the MRO shall determine if the individual was in violation of the Fitness For Duty Program when he or she arrived on site.

I G.10.5 Company Supervisors documenting employee absence from work when called for randcm testing shall forward Attachment 2 to Access Control for retention when completed.
6.10.6 Individuals failing to show up for scheduled testing or failing to provide a sample within two hours or notification shall be denied site access.

- a. If the cause is suspected to be drug or alcohol related, a determination on whether drug or alcohol testing is required may be based on:
- 1. Physical appearance (clear-eyed, pupils dilated, manual dexterity, speech slurred, alcohol smell, etc.).
- 2. If the individual exhibits unusual behavior.
- 3. Medication (prescription or over-the-counter) the individual claims to be taking.
- r. Any other information that corroborates a possible drug or alcohol link.
6.12.6 If the cause is suspected to be other than drug or alcohol related, such as stress, fatigue, or illness, refer the individual to the proper medical authority.
6.12.7 If the individual is determined to be fit for duty, then the individun shall continue to perform assigned duties.
6.12.8 If the individual is determined to be unfit for duty, the Supervisor-Security Shift shall deny the individual in question site access and GQ 10 substeps 6.12.9, 6.12.10 or 6.12.11.
6.12.9 If an individual is unfit for duty and for-cause testing is not required (such as directly attributed to prescription medication), Access Control shall

6.13.12 If a Contract Supervisor, Sponsor, Supervisor, Manager, or Director does not complete Fitness For Duty Training in the required time frame:
- a. Either their personnel shall be reassigned to a trained Supervisor or Sponsor, QB
- b. Personnel working for them shall have their unescorted access temporarily revoked QB
- c. Personnel working for them shall have their ERO duties temporarily reassigned.
6.13.13 Emergency Preparedness shall ensure personnel assigned to the Emergency Response Organization in the TSC or ECC complete required Fitness For Duty Training or their ERO Duties shall be reassigned.
6.13.14 Nuclear Training shall notify Access Control that personnel have completed escort or Supervisory Fitness for Duty Training, q 6.13.15 CSC Supervisors, Managers, and Directors shall ensurc that they and their personnel receive applicable fitness for duty training as specified in this procedure. 6.14.5 Individuals asked to work after admitting to alcohol consumption within the previous five hours who test positive shall be exempt from alcohol related sanctions.
6.14.6 If alcohol consumption occurs after the initial testing, applicable sanctions shall be invoked.

6.16 Apdits 6.16.1 Toledo Edison Company shall only accept Fitness For Duty Programs which have Either been:
- a. Audited by Quality Asaurance and formally approved.
- b. Audited by another licensee and the audit results reviewed by Quality Assurance.
6.16.2 Other Companies or Consultants or Organizations performing work in the Protected or Vital Areas or assigned ERO duties shall adhere to the DBNPS Fitness For Duty Program.
6.16.3 Quality Assurance (QA) shall audit the DBNPS Fitness For Duty Program at least every 12 months.
6.16.4 Audits shall:
- a. Focus on the effectiveness of the Fitness For Duty Program,
- b. Be conducted by individuals knowledgeable in j the subject (s) being audited.
- c. Be ind pendent of both Fitness For Duty Program management and personnel directly responsible for implementation of the Fitness For Duty Program.
6.16.5 Prior to the award of a contract to a testing laboratory, Quality Assurance shall conduct pre-award inspections and evaluations of the laboratory's drug testing operation.
6.16.6 QA shall process audit results and recommendations in accordance with NG-QA-00701, Qdality Assurance Audit and Surveillance.

I 6.18 Acceal/ Reinstatement _ Process 6.18.1 Personnel shall be given the opportunity to appeal access status.
6.18.2 Personnel requesting to appeal access status or request reinstatement following suspension shall notify the Supervisor - Access Control in writing.
6.18.3 The Supervisor - Access Control shall process the request for appeal or reinstatement in accordance with established procedures. l 6.19 Individual _ Confidentiality 6.19.1 Personal information collected and maintained by Access Control and the Medical Review Officer shall not be disclosed to persons other than:
- a. Assigned Medical Review Officers.
- b. NRC representatives.
- c. Appropriate law enforcement officials under court order.
- d. Subject individual or authorized representative.

- 2. Personnel involved in deciding appeals.
- g. Other persons pursuant to court order.
6.19.2 Company representatives shall not withhold evidence of criminal conduct from law enforcement officials.

- a. Ensure the involved NRC employee is escorted.
- b. Notify the Supervisor - Access Control.
6.20.4 Upon being notified of an NRC employee being potentially unfit for duty, during normal working hours, Security shall notify Nuclear Licensing to call the Regional Administrator.
6.20.5 If outside of normal working hours, Security shall notify the NRC Operations Contor.
7.0 RECORDS 7.1 The following quality assurance records are completed by this procedure and shall be listed on the Nuclear Records List, captured, and submitted to Nuclear Records Management in accordance with NG-IM-00106.
