ORDER 1

In an opinion issued February 28, 1989, the United States Court of Appeals for the Third Circuit granted, in part, a petition for review filed by intervenor Limerick Ecology Action. Limerick Ecology Action v.

NRC, Nos. 85-3431, 86-3314, & 87-3508, slip op. at 76. In granting that petition, the Court ordered the agency to give additional consideration to an intervenor contention (DES-5) asserting that, in order to comply with its obligations under the Nationcl Environmental Policy Act, the agency must consider certain design alternatives for the mitigation of severe accidents at the Limerick Generating Station. Id. at 47-48.

We hereby direct the Chairman of the Atomic Safety and Licensing Board Panel forthwith to convene a Licensing Board to conduct such additional proceedings relating to this contention as are necessary to 8905160209 890505 PDR ADOCK 05000352 G PDR fDy

'l comply with the Court's decision. These proceedings shall be conducted in accordance with 10 C.F.R. Part 2, Subpart G and expedited to the extent consistent with fairness to the parties. Any appeal of the J l

Licensing Board's initial decision relating to this contention also shall '

be in accordance with Subpart G.  !

l In its consideration of DES-5, the Appeal Board indicated that l NRC-sponsored studies on severe accident mitigation identified by LEA or submitted to the Licensing Board provided basis and specificity for the contention. ALAB-819, 22 NRC 681, 693-94 (1985). On remand, litigation on this contention should be limited to those mitigation alternatives identified by the Appeal Board as being supported with the required basis and specificity.
