ORDER Pending before the Commission is the motion of applicant Philadelphia Electric Company ("PEC0") requesting that the Commission clarify the status of

. rarick Generating Station, Unit 2, with regard to issuance of an operating license or, in the alternative, grant an exemption under 10 C.F.R. 55 51.6 and 50.12 from any procedural requirement that a lice.nse for Limerick Unit 2 cannot issue. Although PECO has not asked for expedited consideration of its motion, it has asserted that a determination is needed promptly because Limerick Unit 2 will be ready for fuel loading and low power operation sometime during the last two weeks of June.

So that the Comnission may consider the position of all the parties on the issues raised by PEC0's motion promptly, responses to its motion and any reply by PEC0 should be provided in accordance with the following schedule.

Intervencr Limerick Ecology Action (" LEA") shall file its response sn that it is received by the Office of the Secretary on June 16, 1989, and shall 0906190020 890600 V PDR ADDCK 05000352 g $D G PDR

serve that response in such a manner as to ensure that the NRC staff and PECO receive it that same date. The NRC staff shall file its response so that it is received by the Office of the Secretary on June 20, 1989 and shall serve its response upon PECO and LEA by hand or by overnight mail or delivery service. PEC0's reply to the LEA and staff responses shall be filed so that it is received by the Office of the Secretary.on June 23 and the reply shall be served upon the NRC staff and LEA by hand or by overnight mail or. delivery service.

Pending resolution of PEC0's motion, the NRC staff shall not issue any authorization for operation of Limerick Unit 2 beyond those steps necessary for fuel loading and precriticality testing.
