090ER (Denying Requests In AWPP's Submission of January 5,1988)
Under date of January 5,1988, AWPP (Remano) filed a submission captioned "Reaction To Licensee's Time - Defaulted Response For Production of Documents As Ordered By NRC Administrative Judges, November 20, 1987". The Licensee filed an informal response under date of January 15, 1988.
The AWPP submission is quite garbled.
It appears that AWPP complains that, in responding on December 29 to AWPP's request for discovery dated December 7,1987, the Licensee defaulted in failing to certply with the Board's Memorandum and Order dated November 20, 1987 (unpublished). AWPP barrenly alleges that the discovery materials furnished by the Licensee "mostly avoided our auestions".
It asks that the Licensee be directed to comply fully with AWPP's request for 8901250434 800119 PDR ADOCK 05000352 Q

made upon the Licensee's default.
1 In our Memorandum and Order of November 20, 1987, we stated that we "will not tolerate any further failures by the Intervenors to comply with the Board's orders and with the Rules of Practice." We deny what I
is in effect AWPP's motion to compel discovery, since it does not comply with 10 C.F.R. 52.740(f) in failing to set forth the Licensee's response or objections to the request for ciscovery and AWPP's argutents in support of the motion. However, as AWFP should now kncw, the Menorandum and Order of January 11, 1988 extended the Intervenors' time until Februa ry 11, 1988 to serve their answers to the Licensee's motion for summary disposition filed on November 23, 1987.
It is so CRDERED.
