PREHEARING CONFERENCE ORDER On May 12, 1989, pursuant to the Order of the Licensing Board, a prehearing conference was held at the U.

S.

Customs House, Philadelphia, Pennsylvania.

Participants included sounsel for Philadelphia Electric Company, NRC Staff, Federal Emergency Management Agency, Pennsylvania Department of Corrections and the 1

inmates of the State Correctional Institution at Graterford, Pennsylvania.

After consulting with the parties, the Licensing Board found that the issue in the proceeding, as stated by the Commission in its Order of April 14, 1989, that the agency is "to give 1

additional consideration to an inmate contention questioning l

whether the radiological emergency response plan relating to the Graterford Institution complies with the standard of 10 C.F.R.

provided to civilian personnel (e.g.,' bus and ambulance drivers) who may be called upon to assist in the event of an emergency i

personnel as previously planned.

This would make the rece.ipt of j

training by civilian personnel a nonissue.

The parties will l

attempt to stipulate to their future course of action and resolve the remanded issue without the need for a hearing.

The stipulation will discuss the Department of Corrections plan to use its own personnel in any evacuation of the Graterford 1

Institution, the training of the personnel and the revision of j

the emergency plan to reflect the change.

The parties are to submit their stipulation to the Licensing Board by May 30, 1989.
