MEMORANDUM AND ORDER j

On July 26, 1989, the Nuclear Regulatory Comission ("NRC" or "Comission") issued a Memorandum and Orcer directing ti ) NRC staff, and inviting the other parties, to respond to five questions designed to elicit information on the relative environmental impacts of allowing the Limerick Generating Station, Unit 2, to operate at full power pending completion of ongoing consideration of Severe Accident Design Alternatives (SAMDAs) up to the first refueling outage in comparison with the impact of letting the plant remain idle for the same period of time.

Initial responses were due on August 2, with replies due on August 9.

On August 1 Limerick Ecology Action (" LEA"), an intervenor in the Limerick proceeding, filed with the Comission a response to the Comission's order. The response asserted, among other things, that the intervenor did not have the resources to analyze the five issues in such a brief period of time.

The Comission would like to emphasize that, contrary to LEA's assertion, it has not required any party except the NRC staff to provide an initial analysis of,the factual issues presented. The invitation presented to the other parties invited the parties to present any analysis they wished, and to respond to the NRC staff's analysis.

In this regard, LEA may, but need not, perform its own analysis.

If LEA finds fault with the analysis presented by

'f the staff or by the applicant, LEA should, in its response, state with specificity the portions of the NRC staff and applicant's responses with which ~

it disagrees, and outline insofar as possible the specific factual basis for the disagreement.
