4 This is an affirmation / discussion session. We have f

5 five items on the agenda. I am going to ask the Secretary to 6 walk us through those items. I apologize for the delay, but 7 it was unavoidable.

8 MR. CHILK: Mr. Chairr.=.n, two of the' items, 86-64 9 and SECY 86-80, have not been on the schedule the required 10 length of time. I wonder if I might have a vote to hold those 11 on less than one week's notice. '

i 13 MR. CHILK: The first item is SECY 86-64. It's the 14 final rule to modify General Design Criterion 4. The 15 Commission here is being asked to approve a final rule which 16 would modify General Design Criterion of Appendix A to 10 CFR 17 Part 50 to allow the exclusion of certain dynamic effects 18 associated with postulated pipe ruptures in the primary 19 coolant loop piping of pressurized water reactors.

20- All the Commissioners have approved the rule change 1

21 as proposed by the Staff in 86-64. Would you please affirm 22 your vote?

j 25 ALAB 819 in the matter of the Philadelphia Electric Company.

4 j 7 1 In this paper the commission 'is being asked to act on an order 2 responding to a request by the Philadelphia Electric Company 3 by the Limerick Ecology Action and Robert Anthony, Friends of 4 the Earth, seeking Commission review of various aspects of 5 ALAB 819.

6 Chairman Palladino and Commissioners Bernthal, 7 Roberts and Zech have approved the attached order which denies 8 the request for Commission review. Commissioner Asselstine 1

9 has approved in part, he disapproves in part, and has provided l l

10 separate views.

11 Would you please affirm those votes.

18 MR. CHILK: The third item is 86-54, review of ALAB, 19 again in the matter of the Philadelphia Electric Company, in

, l 20 which the Commission is being asked to approve the issuance of I 21 an order acting on a motion filed by Robert Anthony, Friends 22 of the Earth, to reopen the record and a stay of the 23 proceeding of the operation of the Limerick Generating 24 Station, Unit 1.

25 All Commissioners have approved an order attached

1 which denies the motion. Chairman Palladino would provide a 2 modified order.

5 MR. CHILK: The fourth item, 86-64, is a response to 6 Commission questions on-Braidwood. The Commission is being 7 asked to act on an order which denies a petition for review of 8 ALAB 819, and requests parties to submit briefs on an issue as 9

to whether the five-factor test for submission of late-filed 10 contentions-is satisfied by the Intervenor's Amended Quality 11 Assurance Contentions.

12 Commissioners Roberts, Bernthal and Fech have 13 approved the order, which was attached to our March 20th

14 memorandum. Chairman Palladino and Commissioner Asselstine 15 have disapproved and have provided separate views.

18 MR. CHILK: The last item is 86-60.- It's a TMI 19 motion of --

21 MR. CHILK: I'm sorry, 86-80, TMIA motion to dismiss 22 and for stay of Husted hoaring. The Commission here is being 23 asked to respond to a motion by TMIA requesting that the 24 Commission dismiss the order granting Charles Husted a 25 hearing, and to stay the proceedings.
