4 This is an open meeting for the Commission to 5 vote on the Limerick Order, and before we ca'n have such an 6 open meeting, we need a vote to hold this meeting on less than 7 one week's notice.

8 May I have such a vote?

9 CA chorus of ayes.3 10 CHAIRMAN PALLADINO: By.way of background, the 11 Commission had a closed meeting on Limerick adjudicatory 12 matters at 1:30, and at the conclusion of the meeting, f

13 requested General Counsel prepare an order for Commission 14 consideration.

15 As a first step, I would like General Counsel to 16 read the contents of that order, and then I will call for a 17 Commission vote on the order.

18 At the end of the meeting, depending on what we do,

'9 i we will instruct the Secretary with regard to tomorrow's 20 meeting.

24 Then let me turn the meeting over to General 25 Counsel

4 1 MR. PLAINE: Thank you, Mr. Chairman, members of the

- 2 Commission.

3 Just omitting the formal parts that relate to the 4 philadelphia Electric Company Limerick Generating Station, 5 Units 1 and 2, Memorandum and Order.

6 By this Memorandum and Order, the Nuclear Regulatory 7 Commission declines to make effective at this time the Atomic 8 Safety and Licensing Board's Order of May 24, 1934 --

1985 9 that should be -- I'm sorry, sir -- which, together with the 10 prior Licensing Board decision in this proceeding, authori=e6 11 the Director, Nuclear Regulatory Regulation, to issue to the 12 Applicant, philadelphia Electri~c Company, a full power la operating license for the Limerick Generating Station.

14 The Commission finds that important questions 15 regarding the hearing rights of the inmates of the State 16 Correctional Institution at Graterford, pennsylvania have not 17 yet been resolved.

18 Accordingly, the Commission directs the Atomic 19 Safety and Licensing Appeal Board, consistent with conducting 20 a fair and thorough proceeding, to consider expeditiously the 21 issue of the propriety of granting an exemption during the 22 pendency of contentions filed by the Graterford inmates.

23 Should the Appeal Board find that the grant of an 24 exemption denied the Graterford inmates their rights to a 25 hearing, the Appeal Board should take whatever steps are I

5 1 necessary to preserve and give expeditious effect to those 2 rights.

3 Once this matter is resolved, either by the Appeal 4 Board's finding that a grant of the exemption was proper, or, 5 if the Appeal Board finds that the grant of an exemption was 6 improper, by a Licensing Board decision on the contentions, 7 the Commission will again consider the issuance of a full S power operating license for this facility.
