1 P ROCEED ! NO S 2 CHAIRMAN PALLADINO: Good afternoon, ladies and 3 gentlemen. This is an affirmation and possible discussion 1

4 session, and I will ask the Secretary to lead us through the 5 items on the agenda.

6 MR. CHILK: Mr. Chairman, the first item is SECY 7 85-139 and 139C, Disposition of Hearing Request Regarding 8 Material License Amendment. The Commission in this case is 9 being asked to respond to requests for hearings in three 10 material licensing cases as follows: there's an amendment of 11 a B&W license to allow operation of special nuclear material i

12 volume reduction services at Park Township facility.

13 Secondly, there's an application of Precision  ;

14 Materials Corporation for a new license to operate an 15 trradiator facility at Morning Hill, New Jersey, 16 And thirdly, there's an amendment of Sequoyah Fuels 17 Corporation license to add faciliti,es at its existing Sequoyah 18 plant in Gore, Oklahoma to allow conversion of depleted i

1 19 uranium hexafluoride to depleted uranium tetrafluoride.

20 The Chairman himself, Commissioners Asselstine, 21 Bernthal and Commissioner Zech have approved issuing orders  :

22 which would refer the hearing request to the Licensing Board I 23 for disposition by a single administrative judge.

24 Commissioner Roberts disapproved the order. He doesn't object i

25 to granting the hearing, but he does object to the procedures I

-w 1 of an excepted vote in conducting the hearing. Would you 2 please affirm your votes, 3 CHAIRMAN PALLADINO: Aye.

5 COMMISSIONER ZECH. Aye.

6 COMMISSIONER ASSELSTINE: Aye.

7 COMMISSIONER ROBERTS: Aye.

8 COMMISSIONER ROBERTS: And I have views.

9 MR. CHILK: You have views that will be attached.

10 The second item is SECY 85-228 entitled Limerick 11 Generating Station Units 1 and 2, Immediate Effectiveness 12 Review. The Commission here is being asked to address 13 comments by an Intervenor, Limerick Ecology Action, and to 14 determine whether a stay of the effectiveness of the ASLB's 15 second and third Partial Initial Decision identified as LEP 16 84-31 and 85-14 on the Limerich Generating Station is 17 warranted. ,

18 All Commissioners have approved an order with a 19 modification suggested by Commissioner Zech, as was presented 20 to you. Commissioner Asselstine, although he approves the 21 order, would have preferred the original order.

22 The order indicates that the Commission has reviewed 23 the LEA comments and the decision and finds there's nothing 24 that warrants staying the effectiveness of LBP 84-31 and LBP 25 85-14. Would you please affirm your votes.

6 MR. CHILK: The third item also deals with an 7 application; an applicant's request for exemption from 10 CFR 8 Part 50, Appendix E, Section 4.F(1), and before the Commission 9 take action on that I will have to ask the Commission to vote 10 to hold it on less than one week's notice.

12 COMMISSIONER ZECH: Aye.

13 COMMISSIONER ASSELSTINE: Aye.

14 COMMISSIONER ROBERTS: Aye.

15 COMMISSIONER BERNTHAL: Aye.

16 MR. CHILK: Here, the Conmission is being asked to 17 act on a request from the Philadelphia Electric Company for an 18 exemption from 10 CFR Part 50, Appendix E, Section 4.F(1),

19 which requires a full participation emergency exercise within 20 a one-year period prior to the issuance of a full power 21 operating license.

22 All the Commissioners have approved an order 23 referring the exemption request to the Director of NRR for 24 deoiston. Would you please affirm your votes.
