Enclosed is Suffolk County's First Discovery Request Relating to LILCO's Application for Exemption dated May 22, 1984.

In this Request, we have attempted, whenever possible, to avoid duplication of the April 11 and 12 requests rel.ating to LILCO's Low Power Motion. However, if any documents responsive to the attached Request were already provided in response to those April requests, we obviously do not need a second copy -- an identifica-tion of such documents would be sufficient.

Although the Licensing Board has not yet either assumed jurisdiction of LILCO's Application for Exemption or set a discovery schedule, and the. County's Request for Clarification of the Commission's May 16, 1984 Order remains outstanding, we are serving the enclosed Discovery Request at this time to permit LILCO to begin as early as possible the process of responding to it.

Such service does not constitute a waiver of the County's right either to oppose the Application as a matter of law, or to oppose, if appropriate, the discovery schedule that may be set by the Commission or the Licensing Board in the future.
