STN 50-556 and STN 50-557 In response to Mr. Davis' letter of April 11, 1979, to the Board, CASE would note the following:

1. The Ultimate Heat Sink is a shared system and is necessary for safe shutdown. There is nothing in the regulation, Section 100.11(b) (2) , which permits application of the preceeding subsection when, as here, there is a shared shutdown safety system. A prudent reading of the regulation, in light of the problem it attempts to mitigate, necessitates a holding that when two reactors share one safety shutdown system, then 100.ll(b) (2) applies. Any other interpretation will result in a nonconservative approach.
2. As shown by the evidence the Applicant has not testified that the UHS was designed to provide water during a design basis accident and this is contrary to the ASLB decision. The Applicant's statement is that the UHS operates "during a postulated accident." (Tr. p. 625).
3. The reco d in ih h a does not satisfactorily or adequately demonstrate that the reactors are not inter-connected to the extent mentioned in the regulation. See e.g.

4. Mr. Davis' references to the record do not establish the point.

(a) Page 1043, Line 8-18. The witness begs the question.

No facts are given.

(b) Tr . p . 1061 - 1063. The witness, on page 1062, makes one of CASE's points. Safety does not end at shutdown and the referenced accident is the design basis accident. Applicant's witness did not commit to any other purpose for the UHS than to perform "during a postulated accident." (Tr. p. 625) .

5. The record fails to demonstrate that the lack of redundancy is acceptable. This fact, i.e. the failure to establish the acceptability of the lack of redundancy, results in a failure of proof that the reactors do hot come within Part 100.ll(b) (2) .
