Gentlemen:

In accordance with the Applicants' policy of full disclosure, I am enclosing two sets of documents.

The first set of documents consists of (i) Revisions 3 and 4 of design report 22A4365, a report prepared by the General Electric Company that addresses certain dynamic load definitions, and (ii) the affidavit of David F. Guyot and an attached NRC memorandum. These materials are pertinent to Contentions 3 and 16 which were litigated in December 1978 and February 1979 in this case. As the Guyot affidavit. explains, the changes in Revisions 3 and 4 and the matters discussed in the NRC memorandum do not affect the containment design of Black Fox Station in any significant manner.

Purdom January 6, 1982 Page Two The second set of documents concerns actions taken by others to establish a site for an airport in the Inola area. One of the sites being considered is near Black Fox Station. The enclosed documents explain the efforts of local parties and the FAA and NRC to site the airport in a location compatible with the Black Fox site.

Although the NRC memorandum referred to above was written in December 1981, Revisions 3 and 4 of the General Electric report were made available to me in February 1980 for the purpose of sending copies to the Licensing Board and parties. However, these docupants were then stored in my office pending action ~by the NRC Commissioners to remove the licensing moratorium imposed after the accident at Three Mile Island. Unfortunately, in the ensuing 18 months, the General Electric documents were forgotten until they were uncovered during an end-of-year office housecleaning. Clearly, the orderly administration of this proceeding required that the documents be made available prior to the recent litigation on Contention 16 and the December 16 prehearing conference. I apologize for the inconvenience caused by this tardy sub-mission.
