Black Fox Nuclear Generating Station, Docke t Nos. STN 50-556 and STN 50-557 I am in receipt of a letter to you dated February 19, 1979, from Mr. Paul Murphi.

In this letter Mr. Murphy states, "These organizations have had the opportunity but have not actively participated in settlement negotiations."

CASE did, in fact, attend a settlement conference.

CASE did not remain for the whole of the meeting because it was apparent that no settlement was possible.

CASE intends to participate and make known to EPA, CASE's position on any s e t tle:ae n t.

You are further advised that the referenced negotiations had nothing to do with CASE's request for an adjudicatory hearing.

This will ultimately be resolved on appeal.

Any inference that CASE has abandoned its ef forts before the EPA is to be disregarded.
