STATE Or NEW JERSEY DEPARTMENT OF ENERGY GeoRoc H.BARBOUR BOARD OF Pusuc UTiuTIEs

% EseOENT Boano or Pusuc Utsutits N EwAn x , N.J. o noa April 9, 1979 Honorable Jcseph M. Hendrie Nuclear Regulatory Commission 171 H Street, N.W.

Washington, D.C.

Dear Mr. Hendrie:

The recent incident at Three Mile Island Unit No. 2 has raised numerous questions and concerns over the use of nuclear generation, and more specifically, the construction or operating similarities in the desicn er safety features of other nuclear units. It is in the latter that we have a major area of concern at this time. Our interest in this area is not intended to play down our concern over the myriad of questicns raised by the TMI incident. We feel confident that your investigation in this area will be broad and extensive and properly deal with these concerns.

It is our hope that this matter can be resolved as expeditiously as possible.

The construction of Forked River Unit by Jersey Central Power &

Light Company is the area of concern in which the Board proposes a ccmplete investigation and review. It is our desire that through this review process, identification can be made to what extent the plants are similar, and where there are areas of distinct differences.

The Board would like to advise the NRC that as sccn as this imnediate incident and concern involving TMI has abated, we would like the opportunity to discuss this matter with you, at your earliest convenience. Hopefully from this conference, we can identify a strategy that will provide us with a pro-cedure to acccmplish our objective of satisfying ourselves as to the lack of probability of a TMI incident at Forked River.

Sincerely yours,
