Enclosed herewith is a copy of a letter to me from counsel for LILCO relating to discussions resolving the pending discovery l

dispute which was the subject of Suffolk County's Motion To Compel Discovery dated August 26, 1983. That Motion, LILCO's Response of September 12, 1983, and the County's Report of September 27, 1983 were discussed in a conference telephone call among the parties and Judge Brenner, and this letter is filed under Judge Brenner's direction to report the resolution of the dispute.

The enclosed letter from LILCO's counsel, dated September 29, 1983, accurately reflects the resolution of the dispute, with the following clarifications which have been discussed and confirmed with LILCO's counsel:

1. LILCO will provide the County with any and all reports showing the results of the inspection of components of all three emergency diesel generators; however, at this time LILCO believes that such reports will be incorporated in the final Failure 0310040618 830930 gDRADOCK 05000322 PDR

Analysis Associates' Report, and will not be separately issued except as referred to in item (7) of the letter from LILCO's

2. .The discovery agreed to in the letter from LILCO's counsel is in addition to the discovery agreed by LILCO in its Response of September 12, 1983.
3. It is understood that the reports to be supplied by LILCO .

During the conference call with Judge Brenner, he indicated that the County's request to witness all examinations, tests and analyses carried out in connection with the failure analysis pro-cess would be denied. He also stated that it was anticipated that l' the County's consultants would have the right in the future to examine the' failed components and reach their oen conclusions con-cerning the causes of the failures. As noted in the letter from LILCO's counsel, Suffolk County reserves the right to make addi-tional requests for discovery on this subject from time to time.

(7) reports on damage to diesel generator

> components caused by the failure of the crank-shaft in diesel generator 102. At present, the only reports of this type contemplated involve the generator and the diesel engine governor.

(8) reports concerning nondestructive examinations conducted by NES.

It is my undcretanding that LILCO's agreement to produce those documents resolves our present discovery dispute. LILCO understands, however, that the County may make additional dis-covery requests at an appropriate time in the future. I hope this letter accurately reflects our conversation; if it does, I would appreciate your forwarding it to the Board as requested by Judge Brennor in our conference call.
