The staff has also missed some of its agreed-to comment milestones.

Dear Mr. Liparulo:

In a March 6, 1997 letter, the staff forwarded SECY-97-051, " Schedule for the Staff's Review of the AP600 Design Certification Application," which was based on the. November 20 and 21, 1996, scheduling meetings between the staff and Westinghouse.

Certain key information has not been submitted in accordance with the Novem-ber 1996 agreements (see attached). Some of the information has been submit-ted late; other information has not yet been submitted. In some instances, it is the staff's understanding that Westinghouse is delaying its final submittals because they wish to incorporate responses to staff comments on previously-received, advance information. The staff has also missed some of its agreed-to comment milestones.

Although the staff believes that it is desirable for Westinghouse to incorpo-rate responses to early staff feedback based on advance information, Westing-house should not wait for that feedback if such action will cause a signifi- )

cant. delay in the submittal schedule. The staff agreed to review advance information.when it was able to help expedite the review of the AP600, but such review cannot always be provided because of assignments of the staff to l higher-priority activities. For example, Westinghouse is waiting for staff )

inspections, tests, analyses, and acceptance criteria (ITAAC) comments in the containment systems area. While the staff expects to send these comments to ,

. submittal any longer. The containment systems ITAAC represent only a few of the total number of ITAAC, and modifications to these ITAAC to respond to staff comments should not hold up submittal of the entire ITAAC package. g \

In order for the staff to allocate its limited resources appropriately, and assess whether the review schedule described in SECY-97-051 can still be met, )

Westinghouse should submit revised dates for the items listed in the attach-ment as well as other'submittals that Westinghouse expects will be late. The staff concluded that the schedule presented in SECY-97-051 can be achieved if Westinghouse submits timely, high-quality standard safety analysis report, ITAAC, and technical specification information.
