SUBJECT:
REQUEST FOR WITHHOLDING PROPRIETARY INFORMATION - PRESENTATION l
MATERIAL FROM A SEPTEMBER 29 AND 30,1997, ADVISORY COMMITTEE FOR REACTOR SAFEGUARDS THERMAL-HYDRAULIC PHENOMENA j'
SUBCOMMITTEE MEETING
Dear Mr. McIntyre:
u By your letter NSD-NRC-97-5424, dated November 11,1997, Westinghouse submitted the presentation material used at the subject meeting on the AP600 passive containment cooling l
system and requested that certain parts of that material be withheld from public disclosure. The information requested to be withhold was identified by brackets around the material. This request was made in accordance with 10 CFR 2.790 and is supported by affidavit AW-97-1184, l
executed by you on November 13,1997, which claims, in part, that the information is classified as proprietary because "The development of the technology described in part by the information i~
is the result of applying the results of many years of experience in an intensive Westinghouse L
effort and the expenditure of a considerable sum of money." in addition, the affidavit identifies l
the following reasons:
l l.
a.
The information reveals the distinguishing aspects of a process (or component, structure, tool, method, etc.) where prevention of its use by any of Westinghouse's competitors without license from Westinghouse constitutes a competitive economic advantage over -
l-other companies.
b.
It consists of supporting data, including test data, relative to a process (or component,
}
structure, tool, method, etc.) The application of which data secures a competitive economic advantage, e.g., by optimization or improved marketability, g
s l:
c.
competitive position in the design, manufacture, shipment, installation, assurance of quality, %
j Its use by a competitor would reduce his expenditure of resources or improve his t
or licensing a similar product. '
a We have reviewed your letter and the subject presentation material in accordance with the requirements of 10 CFR 2.790 and, on the basis of your statements, have determined that the submitted information sought to be withheld contains trade secrets or proprietary commercial information. Therefore, the presentation material that you identified by brackets will be withheld from public disclosure pursuant to 10 CFR 2.790(b)(5) and Section 103(b) of the Atomic Energy l Act of 1954, as amended. A copy of the subject presentation materialidentified as nonproprietary has been placed in the Nuclear Regulatory Commission's (NRC) Public Document Room.
