Dear Mr. Burchfield:
On June 7, 2019, the U.S. Nuclear Regulatory Commission (NRC) completed an inspection at
your Oconee Nuclear Station, Units 1, 2, & 3 and discussed the results of this inspection with
you and other members of your staff. The results of this inspection are documented in the
enclosed report.
One finding of very low safety significance (Green) is documented in this report. This finding
involved a violation of NRC requirements. We are treating this violation as a non-cited violation
(NCV) consistent with Section 2.3.2.a of the Enforcement Policy.
If you contest the violation or significance or severity of the violation documented in this
inspection report, you should provide a response within 30 days of the date of this inspection
report, with the basis for your denial, to the U.S. Nuclear Regulatory Commission, ATTN:

                                            SUMMARY
The U.S. Nuclear Regulatory Commission (NRC) continued monitoring the licensees
performance by conducting a triennial fire protection inspection at Oconee Nuclear Station,
Units 1, 2, & 3 in accordance with the Reactor Oversight Process. The Reactor Oversight
Process is the NRCs program for overseeing the safe operation of commercial nuclear power

INSPECTION SCOPE
Inspections were conducted using the appropriate portions of the inspection procedures (IPs) in
effect at the beginning of the inspection unless otherwise noted. Currently approved IPs with
their attached revision histories are located on the public website at http://www.nrc.gov/reading-
rm/doc-collections/insp-manual/inspection-procedure/index.html. Samples were declared
complete when the IP requirements most appropriate to the inspection activity were met
consistent with Inspection Manual Chapter (IMC) 2515, Light-Water Reactor Inspection
Program - Operations Phase. The inspectors reviewed selected procedures and records,
observed activities, and interviewed personnel to assess licensee performance and compliance
with Commission rules and regulations, license conditions, site procedures, and standards.

  The NRC team identified a finding and associated non-cited violation (NCV) of very low
  significance (Green), for the licensees failure to provide a water flow alarm for a fixed
  suppression system, in accordance with NFPA 805, Sections 3.9.2 and 3.9.3.
  Description: To assess the NFPA 805, Section 3.9, Automatic and Manual Water-Based Fire
  Suppression Systems requirements, the team reviewed the licensees license amendment
  request (LAR) submittal, dated April 14, 2010. In the referenced section, the licensee
  committed to meeting the NFPA 805, Section 3.9.2 and NFPA 3.9.3 requirements. In this
  instance, during the inspection and review of the fire areas for the 2019 Oconee TFPI the
  NRC identified the licensee was not in compliance with the stated commitment for the AB-
  105, Unit 2, Cable Room as specified and consistent with their stated commitment in their
  license amendment request (LAR), Attachment A - NEI 04-02 Table B-1 Transition of
  Fundamental FP Program & Design Elements. Initial questions related to the requirement
  arose based upon the review of fire area AB-092, Unit 2 Equipment Room. Based upon
  information reviewed, the NRC understood compliance to be consistent with the requirement
  and stated as such in the NFPA 805 Safety Evaluation Report (SER), dated December 29,
  2010. Specifically, Attachment A, NFPA 805, Chapter 3, Fundamental Elements Compliance
  Matrix, Table 3.1-1 NFPA 805, Chapter 3, Fundamental Elements Compliance Matrix,
  Element 3.9.2 stated the licensee complied with the stated commitment which the NRC
  accepted. In part, the requirement stated that each system shall be equipped with a water
  flow alarm consistent with NFPA 805, Section 3.9.2 and all alarms from fire suppression
  systems shall annunciate in the control room or other suitable constantly attended
  location. The team determined that at this time, there are no flow alarms or indication from
  the fire suppression system serving fire area AB-105. To support the basis of why the
  suppression systems are credited, the team reviewed OSC-9314, Fire Risk Evaluation, Rev.
  3, Section 1.2.3, Fixed Suppression. This section stated in part that suppression was required
  to suppress a fire in FA AB-105. The team reviewed the December 22, 2010 update to the

LAR for FA AB-105 and concluded that suppression was required to support transition of an
Existing Engineering Equivalency Evaluation (EEEE). Consistent with NFPA 805, Section
A.2.2.7, the EEEE signifies that a generic letter (GL) 86-10 evaluation was performed prior to
the transition to the NFPA 805 licensing basis to signify a noncompliance with the fire
protection program requirements.
The inspection revealed that commitments to the NFPA 805, Section 3.9.2 and 3.9.3
requirements were also specified by the licensee in OM 280.0023.001, Fire Protection
Design Basis Document OSS-0254.00-00-00-4008, Appendices A, B, & G. In Appendix A,
NFPA 805 Ch 3 Compliance (NEI 04-02 Table B-1) the licensee stated that they complied
with the NFPA 805 requirement to have water flow alarms on all required fixed extinguishing
systems (3.9.2 of Appendix A) and they would ensure all alarms from the fire suppression
system annunciate in the control room or other suitable location (OSS-0254.00-00-4008, Rev.
20 [Sec. 3.3.1.1.3] - Fire Protection Design Basis Document).
This licensing commitment was also in conflict with the conclusion reached in calculation
OSC-8003, the NFPA 13 code compliance calculation for the U2 Cable Room's suppression
system. Calculations OSC-8830 and OSC-8834, which were the NFPA 13 code compliance
calculations for U1 and U3 Cable Rooms' suppression systems, acknowledged the water flow
alarm does not exist.
The referenced calculations were inconsistent with the LAR dated December 22, 2010 and
the SER. These attributes had implications on the selected license commitment (SLC) 16.9.2,
Sprinkler and Spray Systems, which provided the applicable compensatory measures for a
system if it became non-functional. Among the elements referenced in OSS 0254.00-00-
4008, Oconee Fire Protection Design Basis Specification for Fire Protection Program, was
compliance with NFPA 13. The team reviewed OSC-9375, Oconee Fire PRA, Fire Scenario
Report, Rev. 7, which specified the importance of the suppression system as its applicably to
fire areas based upon the formulation of a hot gas layer (HGL). This also provided the basis
for suppression in the respective areas, which included AB-092 and AB-105. According to
Appendix C, the HGL ZOI impact times for the Equipment and Cable Rooms ranged from 33
to 53 minutes. Additionally, FAs AB-089, AB-095, AB-101, and AB-106 also utilized the
manually operated supply valves located at least 12 feet from the floor which without water
flow indication and alarms this could adversely impact fire suppression activities.
Finally, the team reviewed OSC-9887, NFPA-805 Monitoring Program Scoping, Rev. 5 which
stated in section 6.3, PMG component list for Manual Suppression, valves in the section
were required by either fire risk evaluation (FRE) or multi-compartment analysis (MCA). In
this instance, the team concluded the established functional failure criteria for Manual
suppression was based upon the failure of the manual suppression system control valve to
not function as designed which would only be revealed by compliance with the NFPA 805,
Section 3.9.2 and 3.9.3 requirements (i.e. no flow no alarm or indication) upon actuation. The
monitoring program requirements are based upon NFPA 805, Section 2.6 which states in part
that the monitoring program ensures the availability and reliability of the fire protection
systems are features are maintained consistent with the established performance criteria.
Following inspector questioning, the licensee provided a white paper that acknowledged the
noncompliance which was inconsistent with what is required by the SER.

Performance Assessment:

  Performance Deficiency: The licensees failure to provide a water flow alarm for a water-
  based suppression system was a performance deficiency.
  Screening: The inspectors determined the performance deficiency was more than minor
  because it was associated with the Protection Against External Factors attribute of the
  Mitigating Systems cornerstone. Specifically, by not having fire water flow indication and
  alarm capabilities negatively impacts fire suppression capability thus impacting the mitigating
  systems cornerstone objective.
  Significance: The inspectors assessed the significance of the finding using Appendix F, Fire
  Protection and Post - Fire Safe Shutdown SDP. The team assessed the finding using NRC
  Inspection Manual Chapter 0609, Attachment 4, Initial Characterization of Findings, and
  determined the Mitigating System cornerstone was degraded. The team further assessed the
  finding using NRC Inspection Manual Chapter 0609, Appendix F, Attachment 1, Fire
  Protection Significance Determination Process Worksheet, and determined the finding to be
  of very low safety significance (Green) based upon Step 1.4.2. A since the marginal code
  variant suppression system appeared to still protect the targets (such as cable raceways that
  contain cables critical for safe shutdown) in this fire area.
  Cross-Cutting Aspect: Not Present Performance. No cross cutting aspect was assigned to
  this finding because the inspectors determined the finding did not reflect present licensee
  performance.
  Enforcement:
  Violation: Oconee Nuclear Station Units 1, 2, and 3 Renewed Facility Operating License
  Condition 3.D required the licensee to implement and maintain in effect all provisions of the
  approved FPP that complied with 10 CFR 50.48 (c), National Fire Protection Association
  Standard NFPA 805, as specified in the NRC safety evaluation report (SER) dated
  December 29, 2010. Section 3.9.2 of NFPA 805 stated that each system shall be equipped
  with a water flow alarm. Section 3.9.3 stated that all alarms from fire suppression systems
  shall annunciate in the control room or other suitable constantly attended location.
  Contrary to the above, from December 29, 2010 on as required by the SER, the licensee
  failed to equip the water-based suppression system in fire area AB-105 with a water flow
  alarm. Additionally, the licensee failed to assure that alarms from the water-based
  suppression system would annunciate in the control room or other suitable constantly
  attended location.
  Enforcement Action: This violation is being treated as an non-cited violation, consistent with
  Section 2.3.2 of the Enforcement Policy.

On June 7, 2019, the U.S. Nuclear Regulatory Commission (NRC) completed an inspection at

your Oconee Nuclear Station, Units 1, 2, & 3 and discussed the results of this inspection with

you and other members of your staff. The results of this inspection are documented in the

enclosed report.

One finding of very low safety significance (Green) is documented in this report. This finding

involved a violation of NRC requirements. We are treating this violation as a non-cited violation

(NCV) consistent with Section 2.3.2.a of the Enforcement Policy.

SUMMARY

The U.S. Nuclear Regulatory Commission (NRC) continued monitoring the licensees

performance by conducting a triennial fire protection inspection at Oconee Nuclear Station,

Units 1, 2, & 3 in accordance with the Reactor Oversight Process. The Reactor Oversight

Process is the NRCs program for overseeing the safe operation of commercial nuclear power

INSPECTION SCOPE

Inspections were conducted using the appropriate portions of the inspection procedures (IPs) in

effect at the beginning of the inspection unless otherwise noted. Currently approved IPs with

their attached revision histories are located on the public website at http://www.nrc.gov/reading-

rm/doc-collections/insp-manual/inspection-procedure/index.html. Samples were declared

complete when the IP requirements most appropriate to the inspection activity were met

consistent with Inspection Manual Chapter (IMC) 2515, Light-Water Reactor Inspection

Program - Operations Phase. The inspectors reviewed selected procedures and records,

observed activities, and interviewed personnel to assess licensee performance and compliance

with Commission rules and regulations, license conditions, site procedures, and standards.

The NRC team identified a finding and associated non-cited violation (NCV) of very low

significance (Green), for the licensees failure to provide a water flow alarm for a fixed

suppression system, in accordance with NFPA 805, Sections 3.9.2 and 3.9.3.

Description: To assess the NFPA 805, Section 3.9, Automatic and Manual Water-Based Fire

Suppression Systems requirements, the team reviewed the licensees license amendment

request (LAR) submittal, dated April 14, 2010. In the referenced section, the licensee

committed to meeting the NFPA 805, Section 3.9.2 and NFPA 3.9.3 requirements. In this

instance, during the inspection and review of the fire areas for the 2019 Oconee TFPI the

NRC identified the licensee was not in compliance with the stated commitment for the AB-

105, Unit 2, Cable Room as specified and consistent with their stated commitment in their

license amendment request (LAR), Attachment A - NEI 04-02 Table B-1 Transition of

Fundamental FP Program & Design Elements. Initial questions related to the requirement

arose based upon the review of fire area AB-092, Unit 2 Equipment Room. Based upon

information reviewed, the NRC understood compliance to be consistent with the requirement

and stated as such in the NFPA 805 Safety Evaluation Report (SER), dated December 29,

2010. Specifically, Attachment A, NFPA 805, Chapter 3, Fundamental Elements Compliance

Matrix, Table 3.1-1 NFPA 805, Chapter 3, Fundamental Elements Compliance Matrix,

Element 3.9.2 stated the licensee complied with the stated commitment which the NRC

accepted. In part, the requirement stated that each system shall be equipped with a water

flow alarm consistent with NFPA 805, Section 3.9.2 and all alarms from fire suppression

systems shall annunciate in the control room or other suitable constantly attended

location. The team determined that at this time, there are no flow alarms or indication from

the fire suppression system serving fire area AB-105. To support the basis of why the

suppression systems are credited, the team reviewed OSC-9314, Fire Risk Evaluation, Rev.

3, Section 1.2.3, Fixed Suppression. This section stated in part that suppression was required

to suppress a fire in FA AB-105. The team reviewed the December 22, 2010 update to the

LAR for FA AB-105 and concluded that suppression was required to support transition of an

Existing Engineering Equivalency Evaluation (EEEE). Consistent with NFPA 805, Section

A.2.2.7, the EEEE signifies that a generic letter (GL) 86-10 evaluation was performed prior to

the transition to the NFPA 805 licensing basis to signify a noncompliance with the fire

protection program requirements.

The inspection revealed that commitments to the NFPA 805, Section 3.9.2 and 3.9.3

requirements were also specified by the licensee in OM 280.0023.001, Fire Protection

Design Basis Document OSS-0254.00-00-00-4008, Appendices A, B, & G. In Appendix A,

NFPA 805 Ch 3 Compliance (NEI 04-02 Table B-1) the licensee stated that they complied

with the NFPA 805 requirement to have water flow alarms on all required fixed extinguishing

systems (3.9.2 of Appendix A) and they would ensure all alarms from the fire suppression

system annunciate in the control room or other suitable location (OSS-0254.00-00-4008, Rev.

20 [Sec. 3.3.1.1.3] - Fire Protection Design Basis Document).

This licensing commitment was also in conflict with the conclusion reached in calculation

OSC-8003, the NFPA 13 code compliance calculation for the U2 Cable Room's suppression

system. Calculations OSC-8830 and OSC-8834, which were the NFPA 13 code compliance

calculations for U1 and U3 Cable Rooms' suppression systems, acknowledged the water flow

alarm does not exist.

The referenced calculations were inconsistent with the LAR dated December 22, 2010 and

the SER. These attributes had implications on the selected license commitment (SLC) 16.9.2,

Sprinkler and Spray Systems, which provided the applicable compensatory measures for a

system if it became non-functional. Among the elements referenced in OSS 0254.00-00-

4008, Oconee Fire Protection Design Basis Specification for Fire Protection Program, was

compliance with NFPA 13. The team reviewed OSC-9375, Oconee Fire PRA, Fire Scenario

Report, Rev. 7, which specified the importance of the suppression system as its applicably to

fire areas based upon the formulation of a hot gas layer (HGL). This also provided the basis

for suppression in the respective areas, which included AB-092 and AB-105. According to

Appendix C, the HGL ZOI impact times for the Equipment and Cable Rooms ranged from 33

to 53 minutes. Additionally, FAs AB-089, AB-095, AB-101, and AB-106 also utilized the

manually operated supply valves located at least 12 feet from the floor which without water

flow indication and alarms this could adversely impact fire suppression activities.

Finally, the team reviewed OSC-9887, NFPA-805 Monitoring Program Scoping, Rev. 5 which

stated in section 6.3, PMG component list for Manual Suppression, valves in the section

were required by either fire risk evaluation (FRE) or multi-compartment analysis (MCA). In

this instance, the team concluded the established functional failure criteria for Manual

suppression was based upon the failure of the manual suppression system control valve to

not function as designed which would only be revealed by compliance with the NFPA 805,

Section 3.9.2 and 3.9.3 requirements (i.e. no flow no alarm or indication) upon actuation. The

monitoring program requirements are based upon NFPA 805, Section 2.6 which states in part

that the monitoring program ensures the availability and reliability of the fire protection

systems are features are maintained consistent with the established performance criteria.

Following inspector questioning, the licensee provided a white paper that acknowledged the

noncompliance which was inconsistent with what is required by the SER.

Performance Assessment:

Performance Deficiency: The licensees failure to provide a water flow alarm for a water-

based suppression system was a performance deficiency.

Screening: The inspectors determined the performance deficiency was more than minor

because it was associated with the Protection Against External Factors attribute of the

Mitigating Systems cornerstone. Specifically, by not having fire water flow indication and

alarm capabilities negatively impacts fire suppression capability thus impacting the mitigating

systems cornerstone objective.

Significance: The inspectors assessed the significance of the finding using Appendix F, Fire

Protection and Post - Fire Safe Shutdown SDP. The team assessed the finding using NRC

Inspection Manual Chapter 0609, Attachment 4, Initial Characterization of Findings, and

determined the Mitigating System cornerstone was degraded. The team further assessed the

finding using NRC Inspection Manual Chapter 0609, Appendix F, Attachment 1, Fire

Protection Significance Determination Process Worksheet, and determined the finding to be

of very low safety significance (Green) based upon Step 1.4.2. A since the marginal code

variant suppression system appeared to still protect the targets (such as cable raceways that

contain cables critical for safe shutdown) in this fire area.

Cross-Cutting Aspect: Not Present Performance. No cross cutting aspect was assigned to

this finding because the inspectors determined the finding did not reflect present licensee

performance.

Enforcement:

Violation: Oconee Nuclear Station Units 1, 2, and 3 Renewed Facility Operating License

Condition 3.D required the licensee to implement and maintain in effect all provisions of the

approved FPP that complied with 10 CFR 50.48 (c), National Fire Protection Association

Standard NFPA 805, as specified in the NRC safety evaluation report (SER) dated

December 29, 2010. Section 3.9.2 of NFPA 805 stated that each system shall be equipped

with a water flow alarm. Section 3.9.3 stated that all alarms from fire suppression systems

shall annunciate in the control room or other suitable constantly attended location.

Contrary to the above, from December 29, 2010 on as required by the SER, the licensee

failed to equip the water-based suppression system in fire area AB-105 with a water flow

alarm. Additionally, the licensee failed to assure that alarms from the water-based

suppression system would annunciate in the control room or other suitable constantly

attended location.

Enforcement Action: This violation is being treated as an non-cited violation, consistent with

Section 2.3.2 of the Enforcement Policy.
