By letter dated November 7, 2022, (Agencywide Documents Access and Management System Package No. ML22311A036), Duke Energy Carolinas, LLC submitted to the U.S. Nuclear Regulatory Commission (NRC) Oconee Nuclear Station Subsequent License Renewal Application, Appendix E, Environmental Report [ER] Supplement 2 pertaining to the subsequent license renewal of Renewed Facility Operating License Nos. DPR-38, DPR-47, and DPR-55 Oconee Nuclear Station, Units 1, 2, and 3 (Oconee), respectively, pursuant to Section 103 of the Atomic Energy Act of 1954, as amended, and part 54 of title 10 of the Code of Federal Regulations, Requirements for renewal of operating licenses for nuclear power plants.
The NRC staff has initiated the environmental review for the ER supplement. An environmental audit will be conducted remotely by NRC staff during the week of Mary 24, 2023. The environmental audit activities will be conducted in accordance with the enclosed Environmental Audit Plan (Enclosure 1).
To the extent possible, the NRC staff requests the information identified in the Environmental Audit Needs List (Enclosure 2) be made available on the Oconee online reference portal prior to the audit. SUBSEQUENT LICENSE RENEWAL ENVIRONMENTAL AUDIT PLAN OCONEE NUCLEAR STATION, UNITS 1, 2, AND 3
- 1. Background
By letter dated November 7, 2022, (Agencywide Documents Access and Management System
[ADAMS] Package No. ML22311A036), Duke Energy Carolinas, LLC (Duke Energy) submitted an Environmental Report (ER), supplement 2 (the ER supplement), related to its 2021 application (ML21158A193) for subsequent license renewal of Operating License Nos. DPR-38, DPR-47, and DPR-55 for the Oconee Nuclear Station, Units 1, 2, and 3 (Oconee), respectively, to the U.S.
Nuclear Regulatory Commission (NRC) pursuant to Section 103 of the Atomic Energy Act of 1954, as amended. A Federal Register Notice (87 FR 77643) dated December 19, 2022, noted the receipt and availability of the ER supplement.
The NRC staff is conducting an environmental audit of the Oconee site to improve understanding, to verify information, and to identify information for docketing to support the preparation of the environmental impact statement. Specifically, the NRC staff will be identifying pertinent environmental data, reviewing the facility, and seeking clarifications regarding information provided in the ER.
- 2. Environmental Audit Bases
License renewal requirements for environmental reports are specified in title 10 of the Code of Federal Regulations (10 CFR) part 51, Postconstruction environmental reports. As specified by 10 CFR 51.53(c): Operating license renewal stage, (1) Each applicant for renewal of a license to operate a nuclear power plant under part 54 of this chapter shall submit with its application a separate document entitled "Applicant's Environmental ReportOperating License Renewal Stage." Review guidance for the staff is provided in NUREG-1555, supplement 1, revision 1, Standard Review Plans for Environmental Reviews for Nuclear Power Plants:
Supplement 1 - Operating License Renewal.
On February 24, 2022, the NRC Commission issued three orders that addressed subsequent license renewal (SLR) proceedings for five operating nuclear power plants. Two of these orders, Commission Legal Issuance (CLI)-22-02 (ML22055A496) and CLI-22-03 (ML22055A533),
addressed Oconee. In the orders, the Commission concluded that the NRCs NUREG-1437, revision 1, Generic Environmental Impact Statement for License Renewal of Nuclear PlantsFinal Report (the LR GEIS), which the NRC staff relies on in part to meet its obligations under 10 CFR part 51 and the National Environmental Policy Act (NEPA), did not consider SLR. Therefore, the Commission determined that the NEPA reviews for the affected nuclear power plants, including Oconee, were inadequate because those reviews relied upon the LR GEIS.
In CLI-22-03, the Commission allowed that SLR applicants may submit a revised ER providing information on environmental impacts during the SLR period. In such a submittal, SLR applicants must evaluate the impacts of those environmental issues dispositioned in table B-1 in appendix B to subpart A of 10 CFR part 51 and the LR GEIS as generic (Category 1) issues. The NRC staff would then address the impacts of these issues during the SLR period in site-specific environmental impact statements.
On November 7, 2022, Duke Energy submitted a site-specific environmental report of the impacts of continued operations of Oconee during the SLR period (ML22311A036). That report, which supplemented the environmental report included in Dukes 2021 SLR application, addressed each environmental issue previously dispositioned as a Category 1 issue in the environmental 3
report on a site-specific basis.
In accordance with the CLI-22-03, NUREG-1437, Generic Environmental Impact Statement for License Renewal of Nuclear Plants. During the scoping process specified in 10 CFR part 51, the NRC staff is required to define the proposed action, identify significant issues which must be studied in depth, and to identify those issues that can be eliminated from further study.
- 3. Environmental Audit Scope
The scope of this environmental audit is to identify new and significant issues and issues which can be eliminated from further study. The NRC staff will also identify environmental resources that must be described and evaluated in the Supplemental Environmental Impact Statement.
Audit team members will review the documents and other requested information made available on the Oconee online reference portal Identified on the environmental audit needs list (Enclosure 2) and discuss any questions and additional information needs with the applicants subject matter experts.

- 6. Logistics
The environmental audit will be conducted remotely from April 26-28, 2023. An entrance meeting will be held with plant management at the beginning of the audit and an exit meeting will be held at the end of this audit.

Duke Energy staff who are subject matter experts in the disciplines identified on the environmental audit needs list should be available for interviews and tours.
- 8. Deliverables
An audit summary report will be issued by NRC staff within 90 days from the end of the environmental audit.

The U.S. Nuclear Regulatory Commission (NRC) staffs Oconee Nuclear Station Units 1, 2 & 3 (Oconee) site-specific information needs are described below in three categories: tours, meetings, and information needs. Has there been a change in the number of permanent or non-outage workers since 2020? If so, please provide this information.
SOC-2: Please provide updated Oconee Full-Time Employee Residence Information since October 2020 as shown in Table 2.5-1 of the 2021 ER (ML21158A193) or confirm that the residence information has not changed.
SOC-3: Please provide updated population number and population density within both 20- and 50-mile radius of Oconee using the most recent 2020 census data. The information previously presented in section 3.11.1 of the 2021 ER (ML21158A193) was based on the 2010 census data.
SOC-4: Please confirm if Oconee still uses water from the Seneca water treatment plant for potable water.
SOC-5: If available, please provide Oconee property tax payments to Oconee County for 2022?
SOC-6: In the 2021 ER (ML21158A193) and in response to RAI SOC-1 ( ML22019A137), Duke discussed that on December 21, 2020, the South Carolina Administrative Law Court issued a decision and held that Duke Energy is a manufacturer for South Carolina property tax purposes and therefore the property qualifies for a partial manufacturing property tax exemption in South Carolina. Furthermore, the Court ruled that Duke Energy is entitled to the exemption for all of the property used in manufacturing, but property not used in manufacturing is not eligible for the exemption. However, a determination had not been made as to what portion of the property is eligible for the property tax exemption and on October 7, 2021 the Court issued a decision concluding that more evidence is needed to determine what portion of the property qualifies for the exemption and parties are conducting discovery. Provide an update regarding this matter, including if a determination has been made and any anticipated reduction in property tax payments for Oconee.
SOC-7: Section 4.8.2.2 of ER supplement 2 provides tax payments for the years 2020 and 2021. ER supplement 2 goes on to discuss that the tax payment to Oconee County for fiscal year 2020 was lower than other years due to a refund after the appeal to the State of South Carolina (as discussed in section 3.9.5 of the 2021 ER). Table 4.8-2 of ER supplement 2 present property tax adjustment amounts.

Clarify if the appeal in section 4.8.2.2 of ER supplement 2 (ML22311A036) and footnote a of table 4.8.2 of ER supplement 2 (ML22311A036) is referring to Duke Energy appealing the State of Carolina tax year fair market assessment of Duke Energy Carolinas and Duke Energy Progress taxable assets.
Table 4.8-2 of the ER supplement 2 ( ML22311A036) identifies a $4 million appeals payment. Clarify is this payment was made by Duke Energy to Oconee County and the reason for this payment.
SOC-8: Has there been any changes to the primary road network, rail service, airfields, or state highways with access to Oconee from what is discussed in section 3.1.1 and 3.9.6 of the 2021 ER (ML21158A193)? If so, please provide this updated information.
