OF PUBLIC SCOPING MEETINGS CONDUCTED RELATED TO THE REVIEW OF THE CALLAWAY PLANT, UNIT 1, LICENSE RENEWAL APPLICATION The U.S. Nuclear Regulatory Commission (NRC) staff conducted environmental scoping meetings related to the review of the Callaway Plant, Unit 1 (Callaway), license renewal applications submitted by Union Electric Company, a subsidiary of Ameren Corporation and doing business as Ameren Missouri (Ameren).
Two public meetings were conducted on March 14, 2012, at the Fulton City Hall Council Chambers in Fulton, MO. Approximately 50 people attended the meetings.
The attendees included members of the NRC staff, members of the public, representatives from Ameren, news media. and local and State government officials.
Public comments and questions expressed ideas related to both the benefits of license renewal and nuclear power and the disadvantages of the same. Concerns were mainly based on applying lessons learned from the accident at Fukushima, permanent waste storage, and the license renewal process. A combined listing of attendees for both sessions is provided in Enclosure
- 1. Enclosure 2 IS a copy of the meeting agenda. Enclosures 3 and 4 contain the official corrected transcripts for the afternoon and evening meetings, respectively.

And the agenda for the meeting includes a presentation by NRC staff on 7 the license renewal process. And following that we'll 8 have a brief Q&A opportunity to ask any questions or 9 get clarifications on the presentations that you've 1 heard on the license renewal process. 11 And then moving to the public comment 12 period. During the public comment period, that's the 13 NRC's opportunity to listen, so they're listening 1 mode. And that's your opportunity to make your 1 comments.
That's why we have the Q&A session before 16 that to provide any clarifications on the 17 presentations that you're going to hear. And so I have two I have responsibility of overseeing the license renewal projects at the NRC. MS. FELLS: Hi, I'm Carmen Fells 1 17 Environmental Project Manager. 18 MR. FORD: Hi, I'm 11 Ford. I'm a 19 geologist, hydrologist, technical reviewer for the 2 NRC. 2 MS. YANCEY: And my name is Dawn Yancey. 22 I'm a secretary at the Callaway Plant for the Nuclear 23 Regulatory Commission.

My name 7 is Brian Harris. I'm the Safety Project Manager 8 within the Division of License Renewal and I am 9 coordina ting the s 's review associated with the 1 Callaway Plant, Unit 1, License Renewal Application.
1 So thank you all for taking time to come out to 12 today's public meeting. 13 So today we will provide an overview of 1 the license renewal process, which includes both the 1 safety and environmental reviews. We will describe 16 ways in which the public can participate ln the 17 Callaway license renewal process. I'd like to 18 reiterate that the most important part of today's 19 meeting is to receive any comments that you have on 2 the scope of the environmental review. We will also 2 give you some information about how you can submit 22 comments if you prefer not to speak at this meeting 23 today. 24 I hope the information we provide you will 2 help you to understand the license renewal review NEAL R. GROSS COURT REPORTERS AND 1323 RHODE ISLAND AVE., (202) 234-4433 WASHINGTON, D.C. 20005-3701 8 1 process and the roles you all have in the So before I get into the discussion of the 3 license renewal process, I'd like to take a minute to talk about the NRC in terms of what we do and what our mission is. So the NRC is a Federal agency that 7 regulates the civilian use of nuclear material.
The 8 Atomic Energy Act authorized the NRC to grant a 9 year operating license for nuclear power plants. I'd 1 like to highlight that this 40-year term was based 1 primarily on economic considerations and antitrust 12 factors, not on safety or technical limitations.
The 13 Atomic Energy Act also allows for cense renewal. 1 The National Environmental Policy Act of 1 1969, or NEPA, established the national policy for 1 considering the impact of Federal decision-making on 17 the human environment.
Carmen will discuss the NEPA 18 in greater detail. 19 The NRC's mission 1S threefold:
to ensure 2 adequate protection of public health and safety, to 21 promote the common defense and security, and to 22 protect environment.
23 The NRC accomplishes its mission through a 2 combination of regulatory programs and processes, such 2 as establishing rules and regulations, conducting NEAL R. GROSS COURT REPORTERS AND 1323 RHODE ISLAND AVE, (202) 234-4433 WASHINGTON, D.C. 20005-3701 9 inspections, issuing enforcement actions, assessing 2 licensee performance.
We also evaluate operating 3 experience from nuclear plants across the country and internationally as well. The NRC has resident inspectors at all of nuclear power plants. 6 Dave Durnbacher and Zachary Holcroft, Dave is here right now; Zachary will be at this evening's meeting. So these inspectors are considered the eyes and ears of the NRC. And they carry out the safety 1 mission on a daily basis and are our front lines 1 ensuring acceptable safety performance and compliance 12 with the NRC regulatory requirements.
13 So I'd like to mention a few very 1 important areas of the NRC oversight that routinely 1 come up during our interactions with members of the 16 public. The NRC staff addresses these areas of 17 performance every day as part of the ongoing 18 regulatory oversight provided for all currently 19 operating power reactors.
They include current safety 2 performance (as defined by NRC inspection findings, 2 violations, and general assessments of plant 22 performance), emergency planning, and security.
23 For specific information on the current 24 performance of Callaway, you can use the link provided 25 on this slide here. And 's also in your handouts as NEAL R. GROSS COURT REPORTERS AND 1323 RHODE ISLAND AVE., (202) 234-4433 WASHINGTON, D.C. 20005-3701 10 The NRC moni tors and provides regulatory 3 oversight of activities these areas on an ongoing basis under the current operating license. Therefore, we do not re-evaluate this in license renewal. So that's not to say that they're not important.
We just 7 don't duplicate this regulatory process in these areas 8 for license renewal. 9 Well, since the accident at Fukushima, the 1 NRC has taken mUltiple steps to ensure the safe 1 operation of nuclear power plants, both now and into 12 the future. As part of its ini tial response to the 13 accident, the NRC issued temporary instructions to our 1 inspectors directing specific inspections of nuclear 1 power plants in order to assess disaster readiness and 16 compliance with current regulations.
17 The next step in the NRC' s response was 18 the report of the NRC 's* Near-Term Task Force. The 19 purpose of the Near-Term Task Force was to develop 2 near-term recommendations and suggest a framework for 21 us to move forward within the longer term. The 22 Term Task Force issued its report on July 12th, 2012 23 (sic) and recommended 12 overarching recommendations 2 for improvement.
These recommendations are applicable 2 to operating reactors regardless of the license NEAL R. GROSS COURT REPORTERS AND 1323 RHODE ISLAND AVE., (202) 234-4433 WASHINGTON, D.C. 20005*3701 11 renewal The NRC has prioritized the 3 recommendations from the Near-Term Task Force and identi ed additional recommendations.
The Commission has directed the staff to 6 move forward on that can be pursued without 7 delay. And the NRC s f actually issued the related 8 orders and request for additional information in March 9 of this year. I think it was actually this morning or 1 yesterday.
1 To date the NRC has not identified any 12 issues as part of these acti vi ties that call into 13 question the safety of any nuclear facility.
1 Additionally, this review process is going on independent of the license renewal process. Any 16 changes that are identi ed as necessary will be 17 implemented for all licensees, regardless of license 18 renewal status. 19 And the most information on the NRC's 2 1 post-Fukushima activities, including paper 2 containing the draft orders and requests for 22 additional information, can be found on the NRC's 23 website. And we have a link here on this slide here. 2 So the NRC received Callaway's application 25 for license renewal on December 19th, 2011, requesting NEAL R. GROSS COURT REPORTERS AND 1323 RHODE ISLAND AVE., (202) 234*4433 WASHINGTON, D.C. 20005*3701 12 an additional 20 years of operation.
The current 2 operating 1 e for Callaway expires in Licensees can submit an application for license renewal after it has operated 20 years. The NRC has determined that 20 years of operation provides enough information for the staff to make an informed 7 decision on license renewal. 8 So first step of the license renewal 9 process is to perform an acceptance review 1 acceptance and sufficiency review of the application.
1 The purpose of this review is to determine that the 12 applicant provided the required information.
13 Required information includes:
1 Technical information about the plant 1 structures and components and the applicant proposes 16 to manage the aging of these structures and 17 components.
Technical specifications defining the operating parameters of plant. The application indicates if any changes or additions to technical speci cations are necessary to manage the fects of 22 aging during the period of extended operation.
23 And the application also includes an 24 Environmental Report, which is the applicant's 2 assessment of the environmental impacts of continued NEAL R. If the application has the required information t then it is considered acceptable and it is put on the NRC's formal docket and the staff begins its review. So this flow chart that highlights license renewal involves two parallel reviews: the safety review and environmental review. These two reviews evaluate separate aspects of the license renewal application.
It so features other considerations in the Commission's decision of whether or not to renew an operating license. One of these considerations the independent review performed by the Advisory Committee on Reactor Safeguards or ACRS. Statutorily mandated by the Atomic Energy Act of 1954 the ACRS is a group t t of scientists and nuclear experts who serve as a consulting body to the Commission.
The ACRS reviews license renewal application t the NRC staff's safety evaluation t and inspection findings.
The ACRS reports their findings and recommendations directly to the Commission.
So the dotted lines show that the hearings may also be conducted if interested stakeholders submit concerns or contentions and their request for a NEAL R. The Atomic Safety and Licensing Board it's a adjudicatory panel wi conduct these hearings.
The Commission considers the outcome of the hearing process in its decision on whether or not to issue a renewed operating license. And as part of the environmental review, the staff consults with local, state, and federal, and tribal officials, such as the EPA. And the s taf f holds public meetings to receive comments on the Draft EIS. And so now I'm going to describe license renewal review process in a little more detail So order to better understand the license renewal process, it is good to know the safety principles that guide license renewal. And the first principle is that the current regulatory process is adequate to ensure that the licensing bas of all operating plants provides and maintains an acceptable level of safety. The second principle is that the current plant-speci licensing basis must be maintained during the renewal term in the same manner, and to the same extent, as during the original licensing term. In other words, the same rules that apply under the current license will apply in the renewal term. NEAL R. GROSS COURT REPORTERS AND 1323 RHODE ISLAND AVE.. (202) 234-4433 WASHINGTON.
D.C. 20005-3701 15 In addition, a renewed license will 2 include conditions that must be met to ensure the 3 aging of the structures and components important to safety is adequately managed so that the plant's current licensing basis is maintained during the period of extended operation.
7 So the safety review process focuses on 8 the aging of passive and long-lived structures and components in systems that NRC deems important to 1 plant safety. We consider:
1 Safety related systems, structures, and 12 components, for example, the reactor containment; 13 Non-safety related systems, structures, and 1 components which, if they failed, could affect 1 related SSC function, for example, a piece of 16 equipment directly above the safety-related component; 17 and 1 Systems, structures, and components relied 1 upon for compliance with federal regulations for fire 2 protection or environmental qualification, or 2 pressurized thermal shock. 22 The staff's main objective is to determine 23 if the aging effects of the aging will be adequately 2 managed by the applicant.
The results of the safety 2 review are documented in a safety evaluation report, NEAL R. GROSS COURT REPORTERS AND 1323 RHODE ISLAND AVE, (202) 234-4433 WASHINGTON, D.C. 20005-3701 16 1 or SER. 2 So now that you understand what the 3 subject the review, I'll talk about how the NRC looks at all this information.
So safety review comprises of numerous rigorous aspects. The technical staff reviews the applicant's license renewal application and supporting documentation:
To determine the applicant's methodology 1 to identify SSCs wi thin the scope of license renewal 1 and subject to an aging management review, 12 To determine if the methodology has been 13 properly implemented, 1 And to determine, with reasonable 1 assurance, that the effects of aging for certain SSCs 16 will be adequately managed or monitored by new and 17 existing programs and surveillance activi 18 The staff uses site audits or visits to 19 verify technical basis of the license renewal 2 application and to confirm that the applicant'S aging 2 management programs and acti vi ties conforms wi th how 22 they are described in the license renewal application.
23 The staff documents the basis and conclusions of its 2 review in a safety evaluation report which is made 2 publicly available.
NEAL R. GROSS COURT REPORTERS AND 1323 RHODE ISLAND AVE., (202) 234-4433 WASHINGTON, D.C. 20005-3701 17 In addition, a team of specialized 2 inspectors travel to the reactor site to fy the 3 aging management programs are being implemented, modified, or planned consistent with the license renewal application.
So finally, as I have mentioned, the ACRS 7 performs an independent review of the license renewal 8 application, the staff's SER, safety evaluation 9 report, and inspections findings, and makes a 1 recommendation to the Commission regarding the 1 proposed action to the renewal of the operating 12 license. 13 So this ide shows important milestones 1 for the safety review process. It is important to 1 note that these dates are tentative.
Schedule changes 16 may result from a host of reasons. If significant 17 issues are identifi during the license renewal review, the review may be suspended indefinitely or terminated.
So that concludes description of the safety review. And Carmen wi 11 present the 22 environmental portion. 23 MS. FELLS: Thank you, Brian. Good afternoon, my name is Carmen Fells. NEPA established a national policy for considering environmental impacts and provides the basic architecture for Federal environmental reviews. All federal agencies must 7 follow a systematic approach in evaluating potential 8 impacts and also to assess alternatives to those actions. The NEPA process involves public participation and publ disclosure.
1 1 The NRC's environmental regulations 12 implementing the requirement of NEPA are contained in 13 10 CRF 51. Our environmental review considers the impact of license renewal and any mitigation for those impacts considered significant.
We also consider the impacts of alternatives to the license renewal, including the impacts of not issuing a renewed license. We document the review an environmental impact statement which is made publ available.
Ultimately, the purpose of the 22 environmental reVlew to determine whether the 23 environmental impacts of 1 renewal are 2 reasonable and, in combination with other reviews, to 2 make a recormnendation to the Cormnission whether to NEAL R. For a license renewal review, the NRC environmental staff looks at a wide range of potential impacts. Additional we consult with various Federal, State, and local of cials, as as leaders of Indian Nations. Examples include: U.S. Fish and wildlife Service Environmental Protection Agency Missouri Department of Natural Resources Missouri Department of Health and Senior Services Missouri Department of Conservation Missouri State Historic Preservation Offices And Tribal Nations with historic ties to the area around plant. We gather pertinent information from these sources and ensure it considered in our analysis.
The environmental review begins with a scoping process which is an assessment of the specific impacts and significant issues that the should consider in preparing the Callaway Environmental Impact Statement.
Currently, this is where we are within process. Information that we gather from you today and in the next few weeks will be considered and included in the Environmental Impact Statement.
NEAL R. So to improve efficiency, we developed a Generic Environmental Impact Statement that addresses a number of impacts common to all nuclear power 6 plants. The f supplements that Generic EIS with a 7 site specific EIS which we will address issues that 8 are specific to Callaway.
The s f also re-examines 9 the conclusions reached in the Generic EIS to 1 determine if there is any new and significant 1 information that could change those conclusions.
12 The scoping period started on February 13 24th, 2012, when the Notice of Intent to prepare an 1 EIS and conduct Scoping was published in the Federal 1 Register.
The NRC will accept comments on the scope 16 of the environmental review until April 24th, 2012. 17 In general, we are looking for information 18 about the environmental impacts from continued 19 operation of Callaway.
You can assist this process by 2 telling us, for example, what aspects of your local 2 community we should focus on; what local 22 environmental, social, and economic issues the NRC 23 should examine during our review; what other major 2 projects are in progress or planned in the area; and 2 what reasonable alternatives are most appropriate for NEAL R. We are not as familiar with your community as you are, so your comments today help to facilitate a thorough 6 review. 7 Public comments are an important part of 8 the environmental review process. 1 of your comments to us, whether 1 provided verbally during this meeting or in a written 12 letter, fax, or email, are considered and addressed.
13 We respond to each comment as part of our 1 environmental review. The EIS is one of the factors, 1 as well as the several others shown here, that 16 influence the Commission's decision to renew 17 license or not. 1 You can provide written comments by mail to the Chief of Rules, Announcements, and Directives 2 Branch at the addresses provided on this ide. 2 Finally, if you happen to be traveling to 22 the D.C. area, you can provide written comments in 23 person during business hours. 2 This slide shows important milestones for 2 the environmental review process. So any members 1 of the public that have some sort of a standing within 1 this regulatory action. And that's pretty much if 12 you have some standing with the license renewal 13 regulatory action. If you have standing, then you can 1 tion will be --the petition will go to the 1 hearing process. 16 MS. SALTER: Can you elaborate on who 17 would have standing?
Is that defined by the NRC? 18 MR. HARRIS: Yeah, if you have some 19 members that live close to the plant where you have 2 some sort of a financial standing and have property 2 near plant, or if you live near the plant, things 22 of that nature. 23 MS. Our Missouri Union Electric Company 16 has had a significant amount of time to put together 17 their 1,200 page license extension application and 400 18 page environmental report. And the NRC itself is a 19 highly technical institution that solely focuses 2 not solely focuses, but focuses particularly on these 2 license extension applications.
22 My question is, is it reasonable for the 23 NRC to think that the public in our understanding of these highly technical, highly dense documents is 2 2 it reasonable for the NRC to think that the public can NEAL R. 7 MS. FELLS: We base our opportunity to 8 submit comments on past license renewal processes.
9 And in the pas t is the amount of time that has been reasonable for the public to submit comments.
But that is a comment that you can also submit on the process. We will accept and address that comment on the 60-day period allowed for the scoping comment period. MS. So the Missouri Coalition I should have started reading my document first. The Missouri Coalition for the Environment appreciates the opportunity to submit comments to the Nuclear Regulatory Commission regarding the scope of the Supplement to the Generic Environmental Impact Statement of the license renewal for the Callaway Nuclear Reactor. The Missouri Coalition for the Environment is a 42-year old independent statewide environmental non-profit.
It includes members living near the Callaway Nuclear Reactor. The Coalition has a long history of legal intervention with the Callaway Reactor that goes back four decades. Our long-standing concern has been one of public safety and protection of our environment.
The Coalition plans to intervene in the upcoming license proceedings regarding the union Electric Company's license for renewal application.
As a preliminary matter, we request that the NRC extend the deadline for submitting written scoping comments until 30 days after the deadline for submitting hearing requests and contentions.
That NEAL R. GROSS COURT REPORTERS AND 1323 RHODE ISLAND AVE., (202) 234-4433 WASHINGTON, D.C. 20005-3701 30 date April So while we believe it appropriate for the NRC to hold public meetings now in order to explain a license renewal process to the public, it is unreasonable and unfair to require the public to 6 comment on the scope of the Supplemental GElS at this stage of the proceeding.
When the Missouri Coalition for the Environment and other members of the public are reviewing the license renewal application that's 1 four hundred and --excuse me -the 1,200 page highly 1 technical license renewal application and the 400 page 12 highly technical environmental report. 13 With respect to the scope of the 1 Supplemental Generic Environmental Impact Statement, 1 the Missouri Coalition the Environment has two 16 overarching concerns.
First, we believe it is 17 unacceptable for the NRC to rely on the 1996 GElS for the renewal of the Callaway license because it's severely out of date. The NRC should postpone preparation of the Supplemental GElS for the Callaway uni t until it is finalized and revised GElS that it 22 issued for comment in July of 2009. In the 23 alternative it should prepare an EIS, Environmental 24 Impact Statement, for Callaway that addresses 1 2 environmental issues and does not rely at all on a 16 1 2 2 NEAL R. GROSS COURT REPORTERS AND 1323 RHODE ISLAND AVE., (202) 234-4433 WASHINGTON, D.C. 20005-3701 31 1 year-old Given that the draft version of the 3 revised GElS was sued fully two and a half years ago, continued reliance on this old document is utterly unjustif 6 Second the Coalition demands that the 7 Supplemental GElS address the environmental 8 applications of the Fukushima Daiichi Nuclear Reactor 9 accident including the environmental risks posed by I 1 the NRC's apparent decision to postpone implementation 1 of a number of the Fukushima Task Force 12 recommendations for safety and environmental 13 protection upgrades until some undetermined future 1 time. 1 The Supplemental GElS should excuse me 16 the Supplemental GElS should recommendations 17 excuse me --I'll just start over. 18 The Supplemental GElS should address all 19 the Fukushima
-should address all the Fukushima Task 2 Force recommendations that are relevant to Callaway.
2 By (A) identifying which recommendations 22 have been implemented and explaining how they have 23 been implemented.
24 And (B) identifying all recommendations 2 whose implementation has been postponed or explaining NEAL R. GROSS COURT REPORTERS AND 1323 RHODE ISLAND AVE., (202) 234-4433 WASHINGTON, D.C. 20005*3701 16 17 18 19 2 22 23 2 2 32 how that postponement will affect the safety and environme ntal risks pose d by the reactor. I am a local elected official.
I'm not an environmentalist.
But I do have some experience being a Callaway County resident.
And that is that Ameren Missouri has had a his tory of being very responsive whenever an issue has been raised. And I'm sure that when the final regulations are implemented that that will continue.
I certainly hope it will. And certainly I feel that past behavior and this case responsiveness a good predictor of future behavior.
So I do not have any specific concerns regarding that. Being active in my community, I have been involved with Ameren Missouri and found them to be a good corporate tizen. I'd like to speak briefly about two projects Ameren Missouri has been involved with. One of those 1S a tree planting in Holts Summit. And they were a financial contributor.
They NEAL R. GROSS COURT REPORTERS AND 1323 RHODE ISLAND AVE., (202) 234-4433 WASHINGTON, D.C. 20005-3701 33 also provided a great deal of labor when it came time 2 to plant hundreds of trees and shrubs in Holts Summit. 3 They provided expertise for our environmental project. They also throughout the state of Missouri are involved in the Missouri Relief Program. They are a major benefactor for this program which provides free 7 trees to cities and non-profit corporations.
And I 8 just think that that demonstration the respect for 9 the environment should so be taken into consideration.

I'm City Administrator of Fulton, Missouri, and I have been for the past 16 and a half, 17 years. I'm here actually speaking as a citizen because the City Council has not of yet taken an 8 official position on this. But I am 100 percent 9 confident the City Council would be behind every word 1 that I am about to say. 1 The citizens of Fulton like the Ameren 12 plant where it is. We like the operation.
We like 13 the staf We like the safety levels. We are 1 3 incredibly involved the review of the facilit out there. If anyone is concerned about 1 1 the safety record, our records are available online if 17 you want to take the time to look. The inspections 18 are online. You can even ask for the NRC to mail you 19 -email you, put you on a 1 t and get an email to 2 you if you'd like. 2 We've had a great positive ionship 22 with nuclear plant for the 27 years it's been in 23 operation and for the 10 years or so before that when 2 it was under construction.
We hope to be able to 2 maintain that strong relationship for a long time. NEAL R. 6 As I kind said, having been here 17 7 years, I have been involved in dozens and dozens of 8 drills associated with the safety performance the 9 plant. The city is actively involved when it comes to 1 the drills. The City Administrator, myself, there. 1 The Mayor there, the Police Chief, Fire Chief, 12 planning ficials, ci engineers, city utilities.
13 We through our actions support and endorse the Ameren 1 plant. 1 And many times throughout the year, Ameren 1 comes to us and says, "Is there anything we can do for 17 you?" sometimes we take them up on it; sometimes we 18 don't. But they are an incredible corporate zen 19 to the community of Fulton. 2 And like I said, we would to 2 encourage the NRC to agree with this extension.

And our agenda for the meeting, we're going to start off with some presentations by the NRC 6 staff on the license renewal process. And after that 7 we'll take some time for a brief questions and answers on the license renewal process on the presentations that you'll And then we' move on to the public comment period. During the public comment period, 12 it's NRC's time to listen, so they're in listening 13 mode. That's why we have the Q&A before that to 1 answer any questions you may have on the license 1 renewal process or anything that you heard during 1 presentations.

Plus my branch handles the Safety Evaluation part of the license renewal and also it handles the license renewal proj ects throughout time the Agency. MS. FELLS: Good evening. So with that, I'm going to turn it over to Brian Harris to begin the presentations.
MR. HARRIS: Good evening. My name is Brian the Safety Proj ect Manager wi thin the Division of License Renewal of the Nuclear Regulatory Commission and I am coordinating the staff's review 1 1 associated with the Callaway Plant, Unit I, License 12 Renewal Application.
So thank you all for taking time 13 to corne this evening. So tonight we will provide you an overview of the license renewal process, which includes both the safety review and environmental review. And we will describe ways in which the public can participate in the laway license renewal process. I'd like to reiterate that the most important part of tonight's meeting to receive any comments that you may have on the scope of environmental review. We will 22 also give you some information about how you can 23 submi t comments if you prefer not to speak at this 2 meeting. I hope the information we provide will NEAL R. 8 1 help you to unders the license renewal review 2 process and the roles you all have in this process. 3 So before I get into the scussion of the I 1 renewal process I'd like to take a minute to talk about the NRC terms of what we do and what our mission is. 7 The NRC a Federal agency that regulates 8 the civilian use of nuclear material.
The Atomic 9 Energy Act authori the NRC to grant 40-year 1 operating licenses nuclear power reactors.
I'd 1 like to highlight this 40-year term was 12 primarily on economic considerations and antitrust 13 factors I not on or technical limitations.
1 Atomic Energy Act also allows for 1 renewal. 1 The National Environmental Protection Act l 1 or NEPAl of 1969 1 established a national policy 17 considering the impact of Federal ion-making on 18 human env i ronment . And Carmen will discuss the 19 NEPA process in greater detail later in the 2 presentation.
2 The NRC's mission is threefold:
to ensure 22 adequate protection of public health and safetYI to 23 promote the cornmon defense and securitYI and to 2 protect the environment.
2 The NRC accomplishes its mission through a NEAL R. We also evaluate operating experience from nuclear plants across the country and internationally as well. The NRC has resident inspectors at all operating nuclear power plants. And Zachary is here today with us. e inspectors are considered the eyes and ears of the NRC. And they carry out the safety mission on a daily basis and are our front lines ensuring acceptable safety performance and compliance within the regulatory requirements.
So I'd like to mention a few very important areas of NRC oversight that routinely come up during our interactions with members of the public. The NRC staff addresses these areas of performance every day as part of the ongoing regulatory oversight provided for all currently operating power reactors.
They include current safety performance (as ined by NRC inspection findings I violations and general I assessments of plant performance}
I emergency planning I and security.
For specific information on the current performance of Cal I away I you can use the link provided NEAL R. And it S also your 2 handouts as well. 3 The NRC monitors and provides regulatory oversight of activities these areas on an ongoing basis under the current operating license. Therefore, we do not re-evaluate them in the license renewal space. So that's not to say that they aren't important.
We just don' t duplicate the regulatory process in areas license renewal. 1 So since the accident at Fukushima, the 1 NRC has taken mUltiple steps to ensure the safe 12 operation of nuclear power plants, both now and the 13 future. As part of its initial response to the 1 accident, the NRC issued temporary tructions to our inspectors directing speci inspections of nuclear 1 1 power plants in order to assess disaster readiness and 17 compliance with the current regulations.
18 The next step the NRC I S response was 19 report the NRC' s Near-Term Task Force. The 2 purpose of the Near-Term Task Force was to develop 2 near-term recommendations and suggest a framework 22 us to move forward for longer term. The Near-Term 23 Task Force issued its report July 12th and recommended 2 12 overarching recommendations for improvement.
These 25 recommendations are applicable to operating reactors NEAL R. GROSS COURT REPORTERS AND 1323 RHODE ISLAND AVE., (202) 234-4433 WASHINGTON, D.C. 20005-3701 11 regardless of the license renewal The NRC has priori zed 3 recommendations from Near-Term Task Force and has identified additional recommendations.
The Commission has directed the staff to 6 move forward on those that can be pursued without 7 delay. And the NRC staff sued related orders and 8 request for additional information, today actually.
9 To date the NRC has not identified any 1 issues as part of these acti vi ties that would call 1 into question the safety of any nuclear facility.
12 Additionally, review process is going on 13 independent of the license renewal. So any changes 1 that are identified as necessary 11 be implemented 1 for all licensees, regardless of the license renewal 16 status. 17 More information on the NRC's 18 Fukushima acti vi ties, including the paper containing 19 the draft orders and requests for additional 2 information, can be found on the NRC's website by 2 clicking on the Japan Nuclear Accident, NRC actions 22 link on the NRC's home page or directly to the web 23 address on this slide here at the bottom. 2 So the NRC received laway's application 2 for license renewal on December 19th, 2011, requesting NEAL R. GROSS COURT REPORTERS AND 1323 RHODE ISLAND AVE" (202) 234-4433 WASHINGTON, D.C. 20005-3701 12 1 an addi tional 20 years of operation.
The current 2 operating license for laway expires ln Licensees can submit an application for license renewal after it has operated for 20 years. The NRC has determined that 20 years of operation 6 provides enough information for the staff to make an 7 informed decision on 1 e renewal. So the t step of the license renewal process to perform an acceptance and sufficiency 1 review of application.
The purpose of this review 1 is to determine that the applicant has provided the 12 required information to move forward. 13 Some of that required information 1 includes:
1 Technical information about the plant 16 structures and components and how the applicant 17 proposes to manage the aging of these structures and 18 components.
19 Technical specifications defining the 2 operating parameters of the plant. The application 2 indicates if any changes or additions to technical 22 specifications are necessary to manage the effects of 23 aging during the period extended operation.
24 And the application includes an 2 Environmental Report, which the applicant's NEAL R. If the application has the required information, then it considered acceptable and it is put on the NRC's formal docket and the staff will begin its review. So this flow chart highlights license renewal involving two parallel reviews: the safety review and the* envirorunental review. These two reviews evaluate separate aspects of license renewal applicatio
- n. One of these considerations is the independent review performed by the Advisory Committee on Reactor Safeguards, or ACRS. Statutorily mandated by the Atomic Energy Act of 1954, the ACRS is a group of scientists and nuclear safety experts who serve as a consulting body to the Commission.
The ACRS reviews the license renewal application, the NRC staff's safety evaluation, and inspection findings.
The ACRS reports their findings and recommendations directly to the Commission.
So the dotted lines show that hearings may also be conducted if interested stakeholders submit concerns or contentions and their request for a hearing is granted. 'rhe Atomic Safety and Licensing NEAL R. GROSS COURT REPORTERS AND 1323 RHODE ISLAND AVE., (202) 234-4433 WASHINGTON, D.C. 20005-3701 14 Board/ which is an adjudicatory panel/ will conduct 2 these hearings.
The Commission considers the outcome 3 of the hearing process its decision on whether or not to issue a renewed operating license. As part of environmental review/ the staff consults with local/ state/ federal/ and tribal 7 officials/
such as the EPA. And staff holds 8 public meetings to receive comments on the Draft EIS. 9 And so now I'm going to describe the 1 license renewal review process in a little more 1 detail/ starting with the state safety review. So in 12 order to better understand the license renewal 13 process/ it good to know the safety principles that 1 guide license renewal. 1 The first principle is that the current 1 regulatory process is adequate to ensure that the 17 licensing bas of all operating plants provides and 18 maintains an acceptable level of safety. 19 The second principle is that the current 2 plant-speci licensing basis must be maintained 21 during the renewal term the same manner/ and to the 22 same extent/ as during the original licensing term. 23 In other words/ the same rules apply under the current 2 license will apply in the renewal term. 2 In addition/
a renewed license will (202) 234-4433 NEAL R. GROSS COURT REPORTERS AND TRANSCRIBERS 1323 RHODE ISLAND AVE., N.w. WASHINGTON, D.C. 20005-3701 www.nealrgross.com 15 1 include conditions that must be met to ensure aging of 2 structures and components important to safety is 3 adequately managed so that the plant's current licensing basis is maintained during the period of extended operation.
6 So the safety review focuses on the aging 7 of passive and long-lived structures and components in 8 systems that NRC deems important to plant safety. We 9 consider:
1 Safety related systems, structures, and 1 components, for example, the reactor containmenti 12 Non-safety related systems, structures, 13 and components which, if they failed, could affect 1 safety-related SSC functions, for example, a piece of 1 equipment directly above the safety-related component; 16 and 17 Systems, structures, and components ed 18 upon for compliance with federal regulations for fire 19 protection, environmental qualification, pressurized 2 thermal shock, anticipated transients without scram 21 and station blackout.
22 The staff's main objective in this review 23 is to determine if the aging -the effects of the 2 aging will be adequately managed by the applicant.
2 The results of the safety review are documented in a NEAL R. GROSS COURT REPORTERS AND 1323 RHODE ISLAND AVE., (202) 234-4433 WASHINGTON, D.C. 20005-3701 16 safety evaluation report, or So now that you know what is the subject 3 of the review, I' talk about how NRC looks at all of this information.
The safety review is comprised of numerous rigorous aspects. The technical staff reviews the 7 applicant's license renewal application and supporting 8 documentation:
9 To determine the applicant's methodology 1 to identify the SSCs within the scope of license 1 renewal and subject to an aging management review, 12 To determine if the methodology has been 13 properly implemented, And to determine, with reasonable assurance, that the effects of aging for certain SSCs will be adequately managed or monitored by new or existing programs and surveillance activities.
The staff uses te audits or visits to verify technical bas of the license renewal application and to confirm that the applicant's aging management programs and acti vi ties conforms with how 22 they are described in the license renewal application.
23 The staff documents the basis and conclusions of its 24 review in a safety evaluation report, or SERf which is 25 made publicly available.

Finally, as I have mentioned, the ACRS performs an independent review of the license renewal the staff's Safety Evaluation Report and inspections findings and then makes a recommendation to the Commission regarding the proposed action to a renewed operating license. So this slide here shows important estones for the safety review process. It's important to note that these are tentative.
Schedule changes may result from a host of reasons. And if significant issues are identi ed during the 1 renewal review process, it may be suspended indefinitely or terminated.
And that concludes the description of the review. I will turn it over to Carmen Fells the environmental portion. MS. FELLS: Thank you, Brian. Good evening to everyone.
My name Carmen Fells. And I will go over the environmental process. This review is performed in accordance NEAL R. GROSS COURT REPORTERS AND 1323 RHODE ISLAND AVE., (202) 234-4433 WASHINGTON, D.C. 20005-3701 18 1 with the National Environmental Policy Act of 1969, 2 commonly referred to as NEPA. NEPA established a 3 national pol considering the environmental impacts and provides the basic architecture for Federal environmental reviews. All agencies 6 must follow a systematic approach evaluating 7 potential impacts and also to assess alternatives to 8 those actions. The NEPA process involves public 9 participation and public disclosure.
1 NRC's environmental regulations 1 implementing the requirement of NEPA are contained in 12 10 CRF Part 51. 13 Our environmental review the 14 impact of license renewal and any mitigation for those 1 impacts considered significant.
We also consider the 1 impacts of alternatives to the 1 renewal, 17 including the impacts of not issuing a renewed 18 license. We document the review in an environmental 19 impact statement which is made publicly available.
2 Ultimately, the purpose of the 21 environmental review is to determine whether the 22 environmental impacts of license renewal are 23 reasonable and, combination with other reviews, to make a recommendation to the Commission whether to 2 renew the 1 or not.2 NEAL R. GROSS COURT REPORTERS AND TRANSCRIBERS 1323 RHODE ISlAND AVE., NW, (202) 234-4433 WASHINGTON, D.C. 20005-3701 www.nealrgross.com 19 For a license renewal review, NRC 2 environmental staff looks at a wide range of potential 3 impacts. Additionally, we consult with various 4 Federal, State, and local officials, as well as leaders of Indian Nations. Examples include: U.S. Fish and Wildlife Service, Environmental 7 Protection Agency, Missouri Department of Natural 8 Resources, Missouri Department of Heal th and Senior 9 Services, Missouri Department of Conservation, 1 Missouri State Historic Preservation Offices, And 1 Tribal Nations with historic ties to the area around 12 the plant. 13 We gather pertinent information from these 1 sources and ensure it is considered in our analysis.
1 The environmental review begins wi a scoping process which an assessment of the specific 17 impacts and significant issues that the staff should 18 consider in preparing the Callaway Environmental 1 Impact Statement.
Currently, this is where we are in 2 1 the process. Information that we gather from you 2 tonight and in the next few weeks will be considered 22 and included in our Environmental Impact Statement.
23 We've recognized that some impacts are 2 similar, if not identical, at all nuclear power 2 plants. So to improve ficiency, we developed a NEAL R. GROSS COURT REPORTERS AND TRANSCRIBERS 1323 RHODE ISLAND AVE., NW. (202) 234-4433 WASHINGTON, D.C. 20005-3701 www.nealrgross,com 20 Generic Environmental Impact Statement that addresses 2 a number of impacts common to all nuclear power 3 plants. The staff supplements that Generic EIS with a site specific EIS which we will address issues that are specific to Callaway.
The staff also re-examines conclusions reached In the Generic EIS to 7 determine if there is any new and significant 8 information that would change those conclusions.
9 The scoping period started on February 1 24th of this year when the Notice of Intent to prepare 1 an EIS and conduct Scoping was published in the 12 Federal Register.
The NRC will accept comments on the 13 scope the environmental review until April 24th of 1 2012. 1 In general, we are looking for information 16 about the environmental impacts from the continued 17 operation of Callaway.
You can assist this process by 18 telling us, for example, what aspects of your local 1 community we should focus oni what local 2 environmental, social, and economic issues that 21 NRC should examine during our reviewi what other major 22 projects are in progress or planned the area; and 23 what reasonable alternatives are most appropriate for 2 this region. 2 These are just some examples of the input NEAL R. We are not as familiar with your community as you are, so your comments tonight help to litate a thorough review. Public comments are an important part of the environmental review process. So how do we use your comments?
All of your comments to us, whether provided verbally during this meeting or in a written letter, fax, or email, are considered and addressed.
We respond to each comment as part of the environmental review. The EIS is one of the factors, as well as the several others shown here on this slide, that influence the Commission's decision to renew the license or not. In addi tion to providing verbal and written comments at this meeting, there are other ways you can submit comments.

I'm just curious if waste 7 storage situation will have any effect on the license 8 renewal. I hear that the federal government has not 9 yet achieved a permanent waste storage. How will that 1 affect the renewal? 1 MS. SALTER: Brian, you going to talk 12 about that? 13 MR. HARRIS: The waste storage, that's a 14 separate regulatory process in another office wi thin 1 the NRC. So we focus specifically on the license 16 renewal process. We are aware 's managed another 17 office within the agency. MS. SALTER: Is that something you take into consideration in the license renewal or there's another process? MR. HARRIS: That's another process 22 which they'll handle your question.
23 MS. SALTER: Dennis. MR. MOREY: I just want to clarify on 2 that, the waste storage issue. That what we're doing 2 NEAL R. GROSS COURT REPORTERS AND 1323 RHODE ISLAND AVE., (202) 234-4433 WASHINGTON, D.C. 20005*3701 25 in the license renewal is we're amending the Part 50 2 license. Operating
-the reactor opera ted under 3 Part 50 license, which we're mandated to extend it 4 out to 60 years. The waste storage issue, that's a completely different license. I think it's under a different it's like license under Part 71 or something, part of the regulations.
And so that a completely separate matter that'll be handled by under that license. 1 MS. SALTER: Do you have a question here? 1 MS. DANAKER: I'm Erin Danaker, and I have 12 a question regarding the public comment. I really 13 appreciate that you hold these hearings and that you 1 invite comment and that you enable us to make comments 1 on the website, etcetera.
16 My question for you is one of things 17 that we've learned from Fukushima that the 18 inappropriately intimate relationship between industry 19 and government oversight and even academic input on 2 safety requirements for that plant was a factor the accident and the terrible meltdown that occurred 22 2 My question for you is how do you noti area 23 residents about hearings like this order for us and website capability for us to offer comments.2 When I looked at the sign-up sheet when I 2 NEAL R. I can I you we had another meeting earlier and we had a pretty group there. So I would just offer that. MS. We put meeting notice out in the local newspapers.
This meeting was broadcasted on a local news channel and also on a local channel on web. We also have Federal ster notices that we put out, the public can go and access those Federal Register notices. And those notices notify the public of the hearing period, the opportunity to request a hearing, and also the opportunity to submit comments.

The first person I'd like to invite up is LeRoy Benton, who is the Mayor of the city of Fulton. And we will begin with his comments.

BENTON: Thank you the opportunity to voice my opinion this evening. I'm LeRoy Benton. I've been a resident of city of Fulton since 1981. And I moved here about the time that the Ameren UE plant was originally built. Ameren has been and continues to be an excellent corporate neighbor.
I am the Mayor Fulton, but I'm not addressing you that capacity as the City Council has not formally endorsed this license renewal as of this date. However, I'm very confident saying that NEAL R. And I know that safety is the highest priority at the plant just through my dealings 6 and associations with the Ameren personnel throughout 7 the communi ty . I endorse their request for license 8 renewal the current faci ty and encourage a 9 positive response to their request. 1 Ameren's energy campus is a tal part of 1 laway County's and the state of Missouri's economy. 12 As the Environmental Protection Agency regulations to 13 continue to make coal fired plants cost prohibitive to 1 operate, nuclear plants such as the one here at 1 Callaway will of vital importance to the 16 availability and reliability of electricity to the 17 Midwest of the state of Missouri.
And of course 18 without adequate economical supply of electric energy, 1 our national and regional economies will be extremely 2 negatively impacted.

It's Fritzer, 3 but I've been called a lot worse. I hadn't really intended or planned to address the group tonight. I've been out of town today and our Presiding Commissioner came over this afternoon's meeting. And 7 I made a few notes when I found out he had already 8 addressed it. I understand you all had good 9 attendance, so that was good. 1 On behalf of the County Commission, our structure in Missouri I don't know if some of 12 different states are all different on it. But we have 13 three County Commissioners in each one of our 1 counties.
And Missouri has 114 counties.
I also 1 1 happen to be the President of the County 16 Commissioner's Association for the state of Missouri.
17 I was in South Missouri earlier today 18 a meeting down there with a regional group of the 19 commissioners.
And one of the questions they asked 2 about was the status of the current Ameren plant and 2 what's going to happen with unit 2. And I know this 22 isn't a discussion for unit 2. But everyone is very 23 supportive of that, too, for the record. 2 Ameren has been a very good partner the 2 community as LeRoy identified as a resident of NEAL R. 31 1 Callaway County since a few years ago. Back in the 2 '50s, I moved here was to and ever since they 3 started buying up the property to build the original plant with a lot of speculation on what's going to happen. But the fact that it's been in operation for over 25 years, we haven't turned green yet. I think 7 everybody has finally accepted the fact we do have a 8 good base load faci ty here. 9 What's impressed me the most with the 1 operation down there is that they set high standards 11 for themselves for safety and operations.
And 's 12 not just standards for this facility, but they want to 13 be the industry standard.
And that's always impressed 1 me with the management down there. 1 And as we go through our emergency 16 planning drills, we meet on a regular bas Every 17 other year we have a greater drill with the NRC. In 18 off year, we still have the drill. And from those 19 exercises we have a chance to improve upon what we've 2 learned from the previous exercise.
Anything that's 2 changed during the course of the year that's involved 22 in the rollover in the personnel down there. So to 23 keep everybody informed on what's going on and keep in touch on But I think those have been very 2 beneficial.

And the advantage we've seen is that though most of our dril for probably 20 years were all focused on what would happen if was an emergency at the Ameren plant, we've got the same partners and players wi th the ambulance, with the law enforcement, wi th the Sheriff's Department, with the ambulances.
And it's 1 1 given us an opportunity to be ready for tornados, 12 other storms, any type of natural disaster.
13 And over the last couple of years, other 1 counties have started trying to prepare for disasters.
1 Joplin a perfect example. Even at Branson in the 16 past year. We are so much further ahead this 17 county than some of the other counties because of 18 Ameren being located in Callaway County. So we're 19 proud of that fact. 2 That's a big factor that we have, that Fulton and Callaway County have over a of other 22 counties.

A years ago when they replaced the turbines in there, we knew they were going to be asking for an extension of another 20 years. So we're very supportive of that and hope that takes place. Thank you. I have lived in ton my entire Ii So, you know, I grew up with a nuclear plant. It's always been right outside of town and that's just how it's always been since the time I grew up. My generation sees the nuclear plant as jobs and opportuni as well as a provider of cost-effective, base load energy for our community.
Many of my friends' parents work the plant. And through the years I've heard a lot of very posi ti ve NEAL R. I'm a student at Iowa State University studying chemical engineering and considering a minor in nuclear engineering.
I can think of no better career than to be a chemical or nuclear engineer at the Callaway Nuclear Plant. The extension being proposed at this hearing would provide me and those that came before me and those that will come after me job opportunities and clean, reliable energy many years to come. And I'd like to encourage the NRC to approve this license extension.

OF PUBLIC SCOPING MEETINGS CONDUCTED RELATED TO THE REVIEW OF THE CALLAWAY PLANT, UNIT 1, LICENSE RENEWAL APPLICATION The U.S. Nuclear Regulatory Commission (NRC) staff conducted environmental scoping meetings related to the review of the Callaway Plant, Unit 1 (Callaway), license renewal applications submitted by Union Electric Company, a subsidiary of Ameren Corporation and doing business as Ameren Missouri (Ameren).
Two public meetings were conducted on March 14, 2012, at the Fulton City Hall Council Chambers in Fulton, MO. Approximately 50 people attended the meetings.
The attendees included members of the NRC staff, members of the public, representatives from Ameren, news media, and local and State government officials.
Public comments and questions expressed ideas related to both the benefits of license renewal and nuclear power and the disadvantages of the same. Concerns were mainly based on applying lessons learned from the accident at Fukushima, permanent waste storage, and the license renewal process. A combined listing of attendees for both sessions is provided in Enclosure
