MONTICELLO NUCLEAR GENERATING PLANT - REQUEST FORWITHHOLDING INFORMATION FROM PUBLIC DISCLOSURE (TAC NO. MC7596)

Dear Mr. Conway:

By your application dated April 29, 2004, and affidavit dated April 26, 2004, executed byMr. Juan M. Cajigas of Applied Analysis Corporation (AAC), you submitted "License Amendment Request - Selective Scope Application of an Alternative Source Term Methodology for Re-Evaluation of the Fuel Handling Accident" and requested that AAC Calculation Nos.MNGP-001, Rev. 1; MNGP-002, Rev. 2; and MNGP-006, Rev. 0 conveyed by your submittal be withheld from public disclosure pursuant to Title 10 of the Code of Federal Regulations (10 CFR), Part 2, Section 2.390. The affidavit stated that the submitted information should be considered exempt frommandatory public disclosure for the following reasons: a.The information discloses a process, method, or apparatus, including supportingdata and analyses, where prevention of its use by AAC's competitors without license from AAC constitutes a competitive economic advantage over other companies;b. The information which, if used by a competitor, would reduce his expenditure ofresources or improve his competitive position in the design, preparation, assurance of quality, or licensing of a similar service.We have reviewed your application and the enclosed material in accordance with therequirements of 10 CFR 2.390, and on the basis of your statements, we have determined thatthe submitted information sought to be withheld contains proprietary commercial information and should be withheld from public disclosure. Therefore, the calculations identified above, which are marked as proprietary, will be withheldfrom public disclosure pursuant to 10 CFR 2.390(b)(5) and Section 103(b) of the Atomic Energy Act of 1954, as amended.

J. T. Conway- 2 -Withholding from public inspection shall not affect the right, if any, of persons properly anddirectly concerned to inspect the documents. If the need arises, we may send copies of this information to our consultants working in this area. We will, of course, ensure that the consultants have signed the appropriate agreements for handling proprietary information.If the basis for withholding this information from public inspection should change in the futuresuch that the information could then be made available for public inspection, you should promptly notify the NRC. You also should understand that the NRC may have cause to reviewthis determination in the future, for example, if the scope of a Freedom of Information Act request includes your information.
