PRAIRIE ISLAND NUCLEAR GENERATING PLANT, UNITS 1 AND 2 -

REQUEST 1-RR-5-15 AND 2-RR-5-15 TO USE LATER EDITION OF ASME SECTION XI CODE FOR PERFORMANCE OF REPAIR/REPLACEMENT ACTIVITIES (EPID L-2023-LLR-0007)

Dear Mr. Domingos:

By letter dated March 3, 2023 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML23062A141), Northern States Power Company (NSPM or the licensee), a Minnesota corporation doing business as Xcel Energy, submitted a request to the U.S. Nuclear Regulatory Commission (NRC) for the use of a later edition of the American Society of Mechanical Engineers Boiler and Pressure Vessel Code (ASME Code),Section XI, for performance of repair/replacement activities at Prairie Island Nuclear Generating Plant (PINGP), Units 1 and 2.

Specifically, pursuant to Title 10 of the Code of Federal Regulations (10 CFR) 50.55a(g)(4)(iv),

Applicable ISI [Inservice Inspection] Code: Use of subsequent Code editions and addenda, NSPM requested to use later code editions and addenda for ISI items subject to the conditions specified in 10 CFR 50.55a(b). The licensee requested to use Article IWA-4000 of the 2019 Edition of the ASME Code,Section XI, including all related requirements and referenced paragraphs within, for the remainder of the fifth ISI interval. The current applicable Code of Record is the 2007 Edition through 2008 Addenda. The fifth ISI interval started on December 21, 2014, and is scheduled to end on December 20, 2024.

The NRC staff has reviewed the subject request and concludes, as set forth in the enclosed safety evaluation, that NSPM has adequately addressed all of the regulatory requirements set forth in 10 CFR 50.55a(g)(4)(iv) and is in compliance with the requirements of the ASME code,Section XI.

SAFETY EVALUATION BY THE OFFICE OF NUCLEAR REACTOR REGULATION REQUEST TO USE PORTION OF A LATER EDITION OF THE ASME CODE FOR REPAIR REPLACEMENT ACTIVITIES NORTHERN STATES POWER COMPANY PRARIE ISLAND NUCLEAR GENERATING PLANT, UNITS 1 AND 2 DOCKET NOS. 50-282 AND 50-306

1.0 INTRODUCTION

By letter dated March 3, 2023 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML23062A141), Northern States Power Company (NSPM or the licensee) submitted a request to use a portion of a later edition of the American Society of Mechanical Engineers Boiler and Pressure Vessel Code (ASME Code),Section XI, Rules for Inservice Inspection [ISI] of Nuclear Power Plant Components. As noted in Regulatory Issue Summary (RIS) 2004-12 (ML042090436), licensees seeking to use later editions and addenda of the ASME Code,Section XI, that have been incorporated by reference, pursuant to Title 10 of the Code of Federal Regulations (10 CFR) 50.55a(g)(4)(iv), are required to obtain NRC approval.

Specifically, pursuant to 10 CFR 50.55a(g)(4)(iv), NSPM requested to use the 2019 Edition of the ASME Code,Section XI, for the performance of repair/replacement activities for the remainder of the fifth ISI interval for Prairie Island Nuclear Generating Plant (PINGP), Units 1 and 2. The current applicable Code of Record (COR) is the 2007 Edition through 2008 Addenda. The sixth ISI interval for PINGP, Units 1 and 2, will start on December 21, 2024.

2.0 REGULATORY EVALUATION

Pursuant to 10 CFR 50.55a(g)(4)(iv), inservice examination of components and system pressure tests may meet the requirements set forth in subsequent editions and addenda that are incorporated by reference in paragraph (a) of 10 CFR 50.55a, Documents approved for incorporation by reference, subject to the conditions listed in paragraph (b) of 10 CFR 50.55a, Use and conditions on the use of standards, and subject to U.S. Nuclear Regulatory Commission (NRC or Commission) approval. Portions of editions may be used provided that all related requirements of the respective editions are met.

Pursuant to 10 CFR 50.55a(a)(1)(ii)(C)(56), the 2019 Edition of the ASME Code,Section XI, has been incorporated by reference in paragraph (a) of section 50.55a with conditions. NRC RIS 2004-12, Clarification on Use of Later Editions and Addenda to the ASME OM Code and Section XI, provides clarification to the requirements of 10 CFR 50.55a(g)(4)(iv).

Enclosure

Based on the above, and subject to the following technical evaluation, the NRC staff finds that regulatory authority exists for the licensee to request and the NRC to approve the use of subsequent editions and addenda of the ASME Code as requested by the licensee.

3.0 TECHNICAL EVALUATION

3.1 The Licensees Proposed Use of Later Code Editions and Addenda The licensees COR for the fifth ISI interval is the 2007 Edition through the 2008 Addenda. In its March 23, 2023, letter, the license requested to use Article IWA-4000 of the 2019 Edition of ASME Code,Section XI, including all related requirements and referenced paragraphs within.

The requirements of Article IWA-4000 pertain only to repair/replacement activities. Thus, all ISI requirements of the 2007 Edition through the 2008 Addenda would still apply.

3.2 NRC Staff Evaluation Based on the requirements in 10 CFR 50.55a(g)(4)(iv), the NRC staff considered the following criteria in their review of the licensees application:

1. The proposed edition of the ASME Code is incorporated by reference in 10 CFR 50.55a(a).
2. The proposed edition of the ASME Code is subject to the conditions listed in 10 CFR 50.55a(b).
3. The licensee shall request Commission approval to use the proposed edition of the ASME Code.
4. If only portions of editions are to be used, all related requirements of the respective editions must be met.

In evaluating the first criterion, the NRC staff notes that 10 CFR 50.55a(a) incorporates by reference the ASME Code,Section XI, 2019 Edition, as published in the Federal Register on October 27, 2022 (87 FR 65148), becoming effective November 28, 2022. Therefore, the NRC staff finds that the first criterion has been satisfied.

In evaluating the second criterion, the NRC staff observes that the NSPM letter does not propose any alternatives to the provisions of the 2019 Edition of ASME Code,Section XI, IWA-4000, as incorporated by reference. Use of those portions of Section XI would, therefore, be subject to the conditions listed in 10 CFR 50.55a(b). With this understanding, the NRC staff finds that the second criterion has been satisfied.

In evaluating the third criterion, the NRC staff notes that NSPMs March 3, 2023, submittal constitutes a request to the Commission for approval to use a portion of a subsequent edition of the ASME Code,Section XI. Therefore, the NRC staff finds that the third criterion has been satisfied.

In evaluating the fourth criterion, the NRC staff observes that the NSPM letter commits to observing all related requirements and reference paragraphs in IWA-4000 of 2019 Edition of ASME Code,Section XI, as incorporated by reference. Therefore, the NRC staff finds that the fourth criterion has been satisfied.

Based on the above, the NRC staff finds that NSPM has satisfied each of the four criteria of 10 CFR 50.55a(g)(4)(iv) in its request to use a portion of ASME Code,Section XI, 2019 Edition, in lieu of the 2007 Edition through 2008 Addenda of the ASME Code,Section XI, for the PINGP, Units 1 and 2, fifth interval ISI program COR. The NRC staff finds that the licensees proposal is acceptable.

4.0 CONCLUSION

As set forth above, the NRC staff determines that the use of Article IWA-4000 of the ASME Code,Section XI, 2019 Edition, for the remainder of the PINGP, Units 1 and 2, fifth ISI interval is acceptable because NSPM has adequately addressed all the regulatory requirements set forth in 10 CFR 50.55a(g)(4)(iv) and is in compliance with the requirements of the ASME Code,Section XI. Therefore, the NRC staff approves the use of Article IWA-4000 of the ASME Code,Section XI, 2019 Edition, for the remainder of the fifth ISI interval at PINGP, Units 1 and 2, which is scheduled to end on December 20, 2024.
