Hello Margaret, On December 19, 2022, we conducted a MS Teams call to clarify some of the information included in the safety evaluation (SE) for the Kairos Graphite Materials Qualification topical report (TR), and also discuss the next steps in preparation for the meetings with the ACRS.

During this call you confirmed verbally that the SE did not contain proprietary information that was not properly marked/bracketed in the document. We are currently preparing the final SE for

this TR and the transmittal letter, and we will require a written confirmation, via email, indicating the results of your proprietary information review for the then draft SE.

Transmittal of NRC Staff Draft Safety Evaluation Regarding Kairos Power Graphite Materials Qualification Topical Report Ms. Ellenson, By letter dated July 8, 2021, (Agencywide Documents Access and Management System (ADAMS) Accession No. ML21190A218), Kairos Power, LLC (Kairos Power) submitted the topical report (TR) KP-TR-014, Graphite Material Qualification for the Kairos Power Fluoride Salt-Cooled High-Temperature Reactor, Revision 1 for U.S. Nuclear Regulatory Commission (NRC) staff review. The NRC staff completed its review of the information submitted in this report and its subsequent revisions, and finds Revision 4 of the TR (ADAMS Accession No. ML22259A142) acceptable for referencing in license applications subject to the limitations and conditions specified in the NRC staff draft safety evaluation (SE).

The NRC staff placed a copy of the draft SE in the NRC Box folder to which you, John Price, and Darrell Gardner have access. Pursuant to Section 2.390 of Title 1 of the Code of Federal Regulations (10 CFR), the staff determined that the draft SE contains proprietary information and has identified such information with double brackets (( )) throughout the SE. If you believe that any additional information in the draft SE is proprietary, please mark the information line-by-line and define the basis pursuant to the criteria of 10 CFR 2.390. Use double brackets and yellow highlight to identify any additional ((proprietary information)). Please provide comments

on any proprietary aspects and any factual errors or clarity concerns contained in the draft SE within five (5) business days of the date of this email. Your response must be via letter or email from an authorized individual.

Both this email and the draft SE will be placed in ADAMS and made Official Agency Records.

The draft SE will be declared as non-public as it contains proprietary information. This email will be declared public.
