Response to Kairos' Request for Non-Public Documents Related to Security

Dear Ms. Ellenson,

This e-mail is in response to Kairos request, by e-mail dated October 30, 2023 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML23304A311), regarding access to certain non-public documents relating to supplemental security measures for the protection of special nuclear material (SNM) of moderate strategic significance (i.e., Category II SNM). The Commission has determined that the NRC staff may make these documents available to applicants, if the staff can establish the need-to-know. Upon review of the request, the NRC staff has established that Kairos does have the need-to-know for these documents. Therefore, the following documents will be made available to Kairos:

• COMSECY-17-0008, Physical Protection for Non-Power Production and Utilization Facilities Intending to Produce Molybdenum-99, dated February 22, 2017

• SRM-COMSECY-17-0008, Staff Requirements - COMSECY-17-0008 - Physical Protection for Non-Power Production and Utilization Facilities Intending to Produce Molybdinum-99, dated August 1, 2017

• SECY-18-0063, Response to Staff Requirements Memorandum (SRM)-COMSECY-17-0008 on Physical Protection for Non-Power Production and Utilization Facilities Intending to Produce Molybdenum-99, dated June 4, 2018 (excluding Enclosure 1)
