Consultation Update Re: Kairos Power Hermes Non-Power Test Reactor Construction Permit Review Date: Monday, February 13, 2023 1:38:00 PM Kelley and Jennifer, We wanted to make you aware that on December 6, 2022, the NRC received comments from a consulting Tribe on the Kairos draft environmental impact statement (NUREG-2263) which requested that a cultural resources survey be conducted for the proposed project. In the letter, the Tribe also informed NRC of its interest in acting as a consulting party and requested that the NRC include its office in the development of the Archaeological Monitoring and Discovery Plan for the Kairos site.

The consulting Tribe has requested government-to-government consultation with the NRC, and we recently received their approval of a public summary of their comment letter. Based on discussions that I had with the THPO in October 2022, we requested additional information from DOE related to past onsite disturbance. DOE provided NRC with additional information in Mid-November. NRC shared this information with the consulting Tribe on December 1st. NRC met with DOE on December 21st to go over its impressions of the data.

Last week, we communicated information to the license applicant, and wanted to make your respective offices aware of our consultation efforts.
