Supplemental Information from Kairos 20April2023 REDACTED.pdf Ken Attached is the transmittal letter from the Kairos submittal to the NRC on April 20, 2023 of supplemental information provided to facilitate the NRCs ongoing government to government consultations with a Federally Recognized Indian Tribe under Section 106 of the National Historic Preservation Act (NHPA). A public summary of the tribal request can be found at ADAMS Accession No. ML23031A036.
The staff agrees with the Kairos determination that the supplemental information in the April 20, 2023 submittal should be withheld per NHPA statutes and regulations (54 USC 307103 and 36 CFR 800.11(c))
and per provisions under 10 CFR 2.390(a)(9) related to gleotechnical/geophysical information. With Kairos permission this email releases a redacted version of the cover letter from that submittal as a public record of the submittal.
The Kairos April 20, 2023 submittal in its entirety was provided to the consulting tribe. Section 106 consultations are continuing.

Reference 1 submitted the revised Environmental Report as part of the construction permit application for the Kairos Power Hermes test reactor. Additional information is provided in this letter in Enclosure 1 to facilitate NRC staff government to government consultations with a federally recognized Indian tribe under Section 106 of the National Historic Preservation Act (NHPA).
Kairos Power requests withholding of this letter in its entirety from public disclosure consistent with 54 USC 307103, and 36 CFR 800.11(c), Reference 2, and 10 CFR 2.390(a)(3). Enclosure 1 also includes geotechnical and geophysical information and data that should be withheld consistent with 10 CFR 2.390(a)(9).
