Kairos Power Hermes Non-Power Test Reactor Construction Permit Review Date:

Request for DEIS Comments - Thlopthlocco Tribal Town.pdf Mr. Frank,

My name is Jennifer Davis and I am the lead archaeologist for the U.S. Nuclear Regulatory Commissions (NRCs) environmental review for a construction permit for the Hermes non-power demonstration reactor proposed by Kairos Power LLC (Kairos). The facility, if licensed, would be constructed on a site within the East Tennessee Technology Park in Oak Ridge, Roane County, Tennessee.

If a construction permit were granted, it would not authorize operation of the reactor.

Should Kairos choose to proceed with its proposed project, they would need to apply for, and receive, a separate operating license from the NRC. This authorization would constitute a separate NRC undertaking and would require the NRC to prepare a supplement to the construction permit final EIS.

On October 6, 2022, the NRC sent a letter notifying your office of the issuance of the draft environmental impact statement (EIS), to continue NRCs National Historic Preservation Act (NHPA) Section 106 government-to-government consultation, and to invite you to review and comment on the draft EIS (see attached file). As part of our ongoing NHPA Section 106 consultation for this undertaking, I would like to follow up with your office to make sure your office received the letter, and to find out if you have any questions, or comments. The comment period ends on December 6, 2022.

Link to draft EIS: https://adamswebsearch2.nrc.gov/webSearch2/main.jsp?

AccessionNumber=ML22259A126

Chapter 3.5 of the draft EIS contains a discussion of historic and cultural resources and historic properties identified in the direct and indirect area of potential effects, discusses impacts to historic and cultural resources from construction and operation as well as the NRC staffs preliminary determination of no adverse effect to historic properties. It also addresses cumulative impacts to historic and cultural resources and provides a summary of the results of NRCs ongoing NHPA section 106 consultation process. Section 3.5.1.4 includes a summary of consultation comments received from federally recognized tribes during the public scoping period.

If you have any questions, please feel free to contact me by e-mail (Jennifer.Davis@nrc.gov) or by phone at 301-415-3835. In addition, you may also contact the environmental project manager, Mr. Peyton Doub by email (Peyton.Doub@nrc.gov) or by phone at 301-415-6703.

Thank you,

Jennifer

Request for DEIS Comments - Eastern Shawnee Tribe of Oklahoma - ML22243A150.pdf Mr. Barton,

My name is Jennifer Davis and I am the lead archaeologist for the U.S. Nuclear Regulatory Commissions (NRCs) environmental review for a construction permit for the Hermes non-power demonstration reactor proposed by Kairos Power LLC (Kairos). This past April, I spoke with you about this proposed undertaking which, if licensed, would be constructed on a site within the East Tennessee Technology Park in Oak Ridge, Roane County, Tennessee.

On April 4th, you replied to my inquiry stating that after further research and review of your records, we find that No Known Properties of Historical and/or Cultural significance to the Tribe will be impacted by this project.

As part of our ongoing NHPA Section 106 consultation for this undertaking, the NRC sent a letter notifying your office of the issuance of the draft environmental impact statement (EIS),

and to invite you to review and comment on the draft EIS (see attached file). I wanted to follow up with your office to make sure your office received the letter, and to find out if you have any questions, or comments. The comment period ends on December 6, 2022.

Kairos Power Hermes Non-Power Test Reactor Construction Permit Review Date:

Tuesday, November 1, 2022 6:28:00 AM Attachments:

Request for DEIS Comments - Seminole Tribe of Florida.pdf Dr. Backhouse,

Thank you,

Jennifer

Jennifer A. Davis
