KAIROS POWER, LLC - APPLICATION FOR CONSTRUCTION PERMIT FOR HERMES TEST REACTOR, NOTICE OF HEARING, OPPORTUNITY TO PETITION FOR LEAVE TO INTERVENE, AND ASSOCIATED FEDERAL REGISTER NOTICE (EPID NOS. L-2021-NEW-0011 AND L-2021-NEW-0012)

Dear Mr. Hastings:

By letter dated November 29, 2021 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML21319A354), the U.S. Nuclear Regulatory Commission (NRC) informed you that Kairos Power, LLCs application for a construction permit for its Hermes test reactor had been accepted for docketing, and that a notice of acceptance for docketing would be published in the Federal Register. In that notice, which was published in the Federal Register on December 1, 2021 (86 FR 68290), the NRC stated that, in a future Federal Register notice, it would announce the opportunity to petition for leave to intervene in a proceeding on the construction permit application.

Enclosed is a copy of the notice, in accordance with the provisions of Title 10 of the Code of Federal Regulations Part 2, Section 104 (10 CFR 2.104), regarding the opportunity to petition for leave to intervene in the hearing required for the Hermes construction permit application.

The notice includes an order imposing procedures for access to sensitive unclassified non-safeguards information for contention preparation.
