SUBJECT:

Acceptance of DTE Request for Exemption from 10 CFR 72.44(d)(3) for Fermi 2 - Enterprise Project Identification Number L-2021-LLE-0037

Ms. Offerle,

The U.S. Nuclear Regulatory Commission (NRC) staff received DTE Electric Companys (DTEs) submittal dated July 27, 2021 (Agencywide Documents Access and Management System [ADAMS] Number ML21208A259), requesting an exemption from 10 CFR 72.44(d)

(3), which specifies that an annual report be submitted to the NRC regarding effluent releases within 60 days after the end of the 12-month monitoring period, regarding Enrico Fermi Atomic Power Plant Unit 2 (Fermi 2).

The NRC staff has completed the acceptance review of DTEs submittal and concluded that the submittal provides technical information in sufficient detail to enable the NRC staff to proceed with detailed technical review. The subject submittal has been assigned Enterprise Project Identification Number (EPID) L-2021-LLE-0037. Please reference this number and Docket Numbers 50-341 and 72-71 in any future correspondence associated with this request.

Based on our preliminary evaluation and projection of current review schedules, the NRC staff estimates that the review of DTEs submittal will require approximately 180 staff hours, and anticipates completing the formal review by February 2022. This schedule includes the issuance, if needed, of a request for additional information (RAI) and receiving your response to the RAI 30 calendar days after its issuance. Please note that these dates could change depending on the findings of our technical review, urgent assignments, or other factors. We will promptly communicate any significant changes to the schedule.

In accordance with Title 10 of the Code of Federal Regulations, Section 2.390 of the NRCs Agency Rules of Practice and Procedure, a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records component of the NRCs ADAMS. ADAMS is accessible from the NRC Web site at http://www.nrc.gov/reading-rm/adams.html (the Public Electronic Reading Room).

If you have any questions regarding this communication, please contact me at 404-997-4730 or via e-mail to tilda.liu@nrc.gov.
