Screening result of 2.206 petition regarding Fermi Unit 2 Good afternoon Mr. Lodge, This email is to inform you that the NRC staff has screened your April 16, 2020, 2.206 petition in accordance with Section II.A.2(d) of NRC Management Directive (MD) 8.11 Review Process for 10 CFR 2.206 Petitions (ADAMS No. ML18296A043). In your petition you requested that the NRC take enforcement action against DTE Energy related to Fermi Unit 2 based on three concerns: (1) debris in the torus during design basis events; (2) tasks deferred due to COVID-19; and (3) COVID-19 implications on emergency planning (EP).

The NRC staff has concluded, following review in accordance with Sections II.B.1 of MD 8.11, that the three concerns expressed in your petition do not warrant immediate action. However, these requests were further screened as described below.

The first request, related to debris in the torus, screened into the 2.206 process and will be evaluated by a Petition Review Board (PRB).

The two remaining requests have screened out of the 2.206 petition process consistent with the MD 8.11 screening criteria Section II.A.2(d)(v), Requests That Would Not Reasonably Lead to an Enforcement Action, and Section II.A.2(d)(ii), General Assertions and Duplicative Requests for Action under 10 CFR 2.206. Both requests are general assertions without supporting facts. The request regarding deferred tasks does not include any facts specific to Fermi Unit 2 indicating that there are safety tasks that have been improperly deferred in violation of Appendix B to 10 CFR Part 50. Also, your request regarding EP did not identify a specific countermeasure being implemented at Fermi that is not in compliance with the EP or with NRC requirements.

As the PRB begins its evaluation of the torus debris concern, I would like to ensure that you are aware that because the 2.206 petition process is a public process, the petition and all the information in it, including the your identity, will be made public.
