INDIAN POINT NUCLEAR GENERATING STATION, UNIT NOS. 1, 2, AND 3 -

ISSUANCE OF AMENDMENT NOS. 64, 295, AND 271 RE: ORDER APPROVING TRANSFER OF LICENSES AND CONFORMING LICENSE AMENDMENTS (EPID L-2019-LLM-0003)

Dear Mr. Oneid and Ms. Cowan:

By Order dated November 23, 2020 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML20297A325), the U.S. Nuclear Regulatory Commission (NRC) staff approved the transfer of control of Provisional License No. DPR-5 for Indian Point Nuclear Generating Station, Unit No. 1; Renewed Facility License Nos. DPR-26 and DPR-64 for Indian Point Nuclear Generating Station, Unit Nos. 2 and 3, respectively (collectively, with Indian Point Nuclear Generating Station, Unit No. 1, the Indian Point Energy Center); and the general license for the Indian Point Energy Center independent spent fuel storage installation (collectively, the licenses) to Holtec International (Holtec) subsidiaries, Holtec Indian Point 2, LLC (Holtec IP2) and Holtec Indian Point 3, LLC (Holtec IP3). The Order also approved the transfer of Entergy Nuclear Operations, Inc.s (ENOI) authority to conduct licensed activities at the Indian Point Energy Center to Holtec Decommissioning International, LLC (HDI).

The Order also approved draft conforming administrative amendments to the licenses to reflect the proposed transfer and to delete certain license conditions to reflect the satisfaction and termination of certain obligations after the license transfer.

P. Oneid and P. Cowan By letter dated May 26, 2021 (ADAMS Accession No. ML21146A335), ENOI informed the NRCs Office of Nuclear Material Safety and Safeguards (NMSS) and Office of Nuclear Reactor Regulation (NRR) Directors of the planned date of closing (May 28, 2021) of the license transfer transaction. In the same letter, Holtec provided the Directors of NMSS and NRR with pre-notification that Holtec IP2 and Holtec IP3 and HDI has entered into a decommissioning operator services agreement that provides for HDI to act as agent for Holtec IP2 and Holtec IP3 and for Holtec IP2 and Holtec IP3 to pay HDIs costs of post-shutdown operations, including decommissioning and spent fuel management costs.

By letter dated May 27, 2021 (ADAMS Accession No. ML21147A524), HDI provided satisfactory documentary evidence to the Directors of NMSS and NRR that Holtec IP2, Holtec IP3, and HDI have obtained the appropriate amount of insurance required of a licensee under Title 10 of the Code of Federal Regulations (10 CFR) Sections 140.11(a)(4) and 10 CFR 50.54(w). On May 28, 2021 (ADAMS Accession No. ML21147A553), ENOI informed the NRC that the transaction closed on May 28, 2021.

Accordingly, the NRC staff is issuing Amendment No. 64 to Provisional License No. DPR-5 (Enclosure 1), Amendment No. 295 to Renewed Facility License No. DPR-26 (Enclosure 2), and Amendment No. 271 to Renewed Facility License No. DPR-64 (Enclosure 3). A copy of the related Safety Evaluation (ADAMS Accession No. ML20297A333) was provided with the Order dated November 23, 2020, approving the license transfer and the conforming amendment.

Notice of Issuance of the conforming amendment will be included in the NRCs monthly Federal Register notice.

This letter also contains a digitally signed copy of Amendment No. 26 to Indemnity Agreement No. B-19 for IPEC (Enclosure 4). We request that all parties sign the amendment, and return one copy including all signatures to the NRCs Document Control Desk as proof of acceptance. Please keep the other signed original copies for each partys records.

In accordance with 10 CFR 2.390, a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records component of NRCs ADAMS. ADAMS is accessible from the NRC Web site at http://www.nrc.gov/reading-rm/adams.html.
