NOTICE TO APPEAL THE FINAL INITIAL DECISION C0t!CERNING THE REQUEST FOR AN AMENDNENT TO DISPOSE OF A.G.W. BY GPUN This notice is to inform the ASLAB that Joint interveners (JI) SVA and TMI A Intend to appeal the initial Decison served February 3,1989 and received February 6th 1989 by SVA/THI A. SVA/TMI A have been parties in these proceedings. They presented expert testimony, cross examined witnesses and filed Findings of Fact and Conclusions of Law as required, i

This intitial Decision concerned an amendment 10 the License of GPUN and gives the Licensee permission to dispose of 2.3 million gallons of radioactive water by heating the water in en evaporator and thereby removing some of the solids, and vapor 121ng the resultant liquid contelning ,

all of the tritium and amounts of strontium, cesium, plutonium and other d

alpha, gemme, and bete emitters into the air through a heated stack.

Prior to the request for this amendment disposal of the AGW was prohibited by NRC orders, May 1981 and it had been ordered that the water be stored safely on TMI and used for the clean-up. Clean-up is ongoing.

This appeal notice is being submitted and will be followed by a brief supporting JI's position on appeal in accordance with 10 CRF 2.762 (b).
