i GPUN'S SUPPLEMENTAL MEMORANDUM I At oral argument on the lappeal of Charles Husted from the April 2, 1987 initial decision of the Administrative Law Judge, l the Appeal Board asked counsel for GPUN whether an individual has to have a license to be an instructor. Oral Argument, Tr. 30 (Moore, J.). The Board requested that GPUN submit a supplemental memorandum in response to the question. GPUN herein responds to the Board's request.

On October 28, 1980, by a vote of 4-0, the Commission ap-proved NUREG-0737, " Clarification of TMI Action Plan Require-ments," which is a letter from D. G. Eisenhut, Director of the Division of Licensing, Nuclear Reactor Regulation, to licensees of operating power reactors and applicants for operating licenses forwarding post-TMI requirements. See 45 Fed. Reg. 85,236 (1980). One of the criteria for reactor operator training and licensing contained in NUREG-0737 requires: " training center and facility instructors who teach systems, integrated responses, OO22 870918 h

The icentical criterion'is contained in.GPUN's-Licensed Operator Requalification Program. i (Unit 1), revision numberfl, the contents of which was'the sub-ject'of testimony in the remanded TMI-1 restart proceedings on the training of licensed operators.1/ See Metropolitan Edison Co. 32,409, at 38 regarding Instructor Training).

Additionally, GPUN has confirmed that there have been sub-stantial' remunerations-made annually to all TMI-1 licensed per-sonnel which Mr. Husted forfeited due to the termination of his license. Oral Argument, Tr. 29-30 (exchange between D. Bauser and Judges Moore and Wilber).
