Memorandum (Memorializing Conference Call)

At the request of Licensee's counsel, a telephonic conferf.nce call was held on May 11, 1988. Participants were Mr. Baxter, counsel for Licensee; Ms. Skolnick, representing the Joint Intervenors; and Mr. Lewis, counsel for the NRC Staff. Mr. Baxter advised that Mr. McKinstry, counsel for the Conmonwealth of Pennsylvania, had stated that he was not interested in participating in the conference call.

Mr. Lewis requested an extension of time from May 16 to May 23, i 1988 within which to file the Staff's motion (s) for suninary disposition.

l Absent objection, the Board granted the Staff's request for the time l extension.

Mr. Baxter stated that, on May 9,1988, the Licensee had filed a l

Memorandum and Order of April 6 and the Order of April 25, 1988, the Licensee promptly will make available for inspection and copying the preliminary drawings and the bill of materials submitted in January, 1988, by its evaporator system vendor (Pacific Nuclear Systems, Inc.)

which contain the coments added thereto by the Licensee, and that the vendor's second round f drawings, which are due at any time (are overdue now), will be made available for inspection and copying as soon as received. Ms. Skolnick was agreeable to this method of production.

The Board ruled that it would not consider Licensee's motion for summary disposition filed on May 9 regarding Joint Intervenors' Contention 4(b),

(c) and (d) until said preliminary drawings and the bill of materials and the second round of drawings are made available to the Joint Intervenors and the Staff for inspection and copying,' and that, ence these documents have been made available, the Joint Intervenors and the Staff shall respond to the Licensee's motion for summary disposition regarding Contention 4(b) (c) and (d) within 35 days from the date the Licensee's motion for summary disposition was served or 15 days from the date the second round of drawings are made available, whichever date is later. ,

Ms. Skolnick requested that Licensee be directed to advise why it had selected Pacific Nuclear Systems, Inc. rather than some other vendor. In light of the Licensee's objection that such a request had not been made during the discovery period, the Board denied the request.

Finally, Mr. Baxter advised that the Licensee would be filing additional motions for sumary disposition regarding other contentions on or before the due date of May 16, 1988.
