' This is in response to your October 12, 1971, request for authorization to operate Units 1 and 2 of the Quad-Cities Station 'at power levels of up to 50 percent of aggregate station power.

Your request-is subject to the provisions of section D.3 of Appendix 0 of 10 CFR Part 50 and our consideration of your request has been in-accordance with that section.

Additional study of the environmental effects of operation at the 50 percent power level will be necessary before we can consider authorizing you to operate the station at that power level. We have, however, com-pleted our review, in accordance with section D.3 of Appendix D, of operation of ,the station at 20 percent of full power and have determined that operation of the station at that power level could be authorized.

This determination, a copy of which is enclosed, has been made on the basis of our consideration and balancing of the factors described in paragraph 2 of section D.3 of Appendix D and upon making the findings specified in 10 CFR 5 50.57(a).

Based on the above, we are prepared to issue licenses which would authorize the operation of Units 1 and 2 at power levels up to 20 percent of rated power for each unit. However, as you know, on December 13,1971, the U. S. District Court for the District of Columbia issued an order enjoining the Conmission from issuing any partial operating license for the Quad-Cities Station pursuant to section D.3 of Appendix D until the procedures of Section 102(2)(c) of the National Environmental Policy Act of 1969 (NEPA) have been complied with. Accordingly, we may not at this time s issue the licenses authorizing partial operation of the Quad-Cities Station.
