l DETERMINATION TO CONTINUE CERTAIN ACTIVITIES AT THE WM. H. ZIMMER NUCLEAR POWER STATION 1
Pursuant to the provisions of Section 50.10 of 10 CFR Part 50 of the Atomic Energy Commission's (Commission) regulations, the Commission has determined that The Cincinnati Gas & Electric Company, the Columbus and Southern Ohio Electric Company, and The Dayton Power and Light Company (the applicants) may continue certain site preparation activities involving the Wm. H. Zimmer Nuclear Power Station prior to a decision regarding the issuance of a construction permit.
In an application dated April 6, 1970, The Cincinnati Gas & Electric Companf, the Columbus and Southern Ohio Electric Company, and The Dayton Power and Light company applied for a permit to construct a boiling water nuclear power reactor, designated as the Wm. H. Zimmer Nuclear Power Station, located on the Ohio River in Clermont County, Ohio. On March 21, 1972, the Commission adopted revised regulations concerning site prepara-tion, and, by letters dated March 31, 1972, and April 19, 1972, the applicants submitted in accordance with Section 50.10 of 10 CFR Part 50, as revised, reasons why site preparation activities already commenced at the Zimmer site should be permitted to continue.

, involves grading, road construction, site drainage, excavation and recompaction in the circulating water piping, reactor, and turbine generator areas, preparation and erection of temporary buildings for construction, and construction of a river terminal and related facilities.
(This latter activity does not incluJe disturbing the river bed.)
On the basis of the applicants' environmental report and the Commission's Draft Environmental Statement Related to the Proposed 1
Construction of the Wm. H. Zimmer Nuclear" Power Station and the supple-mental information submitted by the applicant on March 31, 1972, and on April 19, 1972, and after consideration and balancing of the environmental factors specified in 10 CFR 8 50.10(d)(2) of the Commission's regulations, it has been determined that the continuation of the above-mentioned site preparation activities is authorized pending a decision concerning the issuance of a construction permit to the applicants for the Wm. H. Zimmer Nuclear Power Station.
This determination shall have no bearing upon the subsequent granting or denial of a construction permit for the proposed,Wm. H. Zimmer Nuclear Power Station and any site preparation work shall be performed entirely at the risk of the applicants.
The basis for making this determination is set forth in a document entitled " Discussion and Findings by the Directorate of Licensing, U.S.
