REQ' JEST FOR 00CUMENTS/INFORMATION RE EX PARTE RULE In regard to the attached May 8,1987 letter to the Chairman from Senators Breaux and Simpson, would you please search your files for any information regarding possible attempted oral or written contacts with.
Commission adjudicatory decisionmakers or Commission adjudicatory advisors in the Shoreham OL proceeding in violation of NRC's ex parte rule or the APA.
If you do have such information or have any questions about this request, contact Mike Blume or Marty Palsch, OGC. We need the information, including negative replies in writing, as soon as possible and, in any event, no later than May 18, 1987.

Dear Mr. Chairman:
On May 14, 1987 the Subcomittee on Nuclear Regulation of the Committee on Environment and Public Works will conduct an oversight hearing on external influences on the Nuclear Regulatory Commission's (NRC) adjudicatory procedures in the Shoreham proceeding.
i Specifically, the hearing will focus on allegations that j
persons outside the NRC may have improperly contacted Commission decisionmakers, with regard to matters being contested in the i
Commission's adjudicatory proceeding on the application of the Long Island Lighting Company to receive an operating license for the Shoreham Nuclear Power Plant.
To assist the Subcommittee in performing its oversight responsibilities in this area, we request that you or your l
designated representative appear before the Subcommittee to-l provide testimony regarding whether any person or persons have made any ex parte communications in NRC's Shoreham proceeding.

In addition, please provide all documents, memoranda, notes, j
records, recordings, tapes, logs, calendars and diaries containing information relevant to the above questions that have not already been provided to the Subcommittee.
This request i
includes both agency and personal records.
We also request that your written and oral testimony provide a brief description of the NRC's ex parte rule.
