May 15, 1987 T1-0FFICE OF THE COMMIS$10N ER

'i NOTE FOR:

William Parler, OGC FROM:

StephenSchinki,OCMh,o

SUBJECT:

SHOREHAM Q PARTE CONTACTS This is in response to the May 8, 1987 request by Senators Breaux and Simpson for all records of ex parte contacts between persons outside the NRC and Commissioners or theTr staffs regarding the Shoreham proceeding.

i There have been repeated attempts by various Congressmen, in both Congressional hearings and letters, to influence the Commission in the j

Shoreham proceeding. These constitute not only violations of ex 3arte principles but the Pillsbury doctrine as well.

In addition, the !:ommission has received correspondence from time to time from members of the public in the area of the facility.

I assume that Docketing and Service has served W

these letters on the parties to the proceeding.

l Other than the above-mentioned contacts, there have been no attempts of

[

which this office is aware by anyone outside the agency to contact.either Commissioner Bernthal or any member of his staff to discuss the Shoreham proceeding.
