Dear Mr. Chairman,

I note with extreme dismay recent developments l

i concerning the licensing process of the Long Island Lighting Company's (LILCO) nuclear plant at Shoreham.

I am aware that on April 14, 1987, LILCO petitioned to the Nuclear Regulatory Commission (NRC) to raise the approved ' n7 level of the Shoreham nuclear power plant to 25 percent '

)

power.

Clearly, the ultimate concern in the licensing 1 process is to determine whether or not the heal.th and safety of the mesidents can be guaranteed. As you are aware, there has been considerable debate as to whether the residents of Long Island can be evacuated in the event of a nuclear 7

accident at Shoreham.

I feel this request is particularly insensitive in light of the recent debate on the proposed rule change l

concerning the participation of State and local governments i in emergency planning. The issue over who has final.  ;

jurisdiction in this area and who would participate in the i event of an accident is yet to be resolved. Until"the issue >

of non-cooperation by New York State and Suffolk County is resolved, issuing any license greater than the five-percent license that currently exists would be irresponsible.  ;

I For the NRC to make the determination that Shoreham could be energized to 25-percent of its capacity in a matter of weeks in order to alleviate supposed " energy shortages" j would be inappropriate. In addition, I would very much like to know if this license is merely an interim license request or whether LILCO intends to continue 25-percent operation in the fall or indefinitely.
