IMPOSITION OF CIVIL PENALTIES - $110,000 By EN 85-40 dated May 21, 1985, the Commission was notified of the intent of IE to issue a Notice of Violation and Proposed Imposition of Civil Penalties in the j

amount of $130,000 to Louisiana Power & Light Company (LP&L). This action was based on violations identified during inspections conducted to review and evaluate allegations received in 1983 related to the adequacy of the LP&L Quality Assurance Program at the Waterford 3 Steam Electric Station. These violations illustrated i

significant weaknesses that existed in LP&L's implementation of its Quality Assurance Program during construction, even though they did not appear to have led to an end-product of unacceptable quality. The violations were characterized t

in the aggregate as a Severity Level III problem.

In determining the civil _

i penalty amount, the Staff considered when the vio!ations occurred, the duration i

of the violations, the existence of prior notice of many of the violations and the fact that many of the violations contained multiple examples.

. The licensee responded to the Notice in a letter dated July 19, 1985. After careful consideration of the licensee's response, the staff has concluded that i

two of the thirteen violations and a few examples of other violations should be l

withdrawn, and that some mitigation of the civil penalties is also warranted.

i Accordingly, an Order Imposing Civil Penalties in the amount of One Hundred Ten Thousand Dollars $110,000 has been issued today. Under the terms of the Order, l

the licensee may within 30 days of the date of the Order, pay the civil penalty j

or request a hearing.
