Subject:

PROPOSED IMPOSITION OF civil PENALTY - $110,000 This is to inform the Commission that a Notice of Violation and Proposed imposition of Civil Penalty in the amount of $110,000 will be issued on or about December 1,1997 to the Nebraska Public Power District. ' This action is based on a Severity Level 111 problem involving numerous violatio.7s of failure to either identify or correct conditions adverse to quality. The most significant examples were failure to identify and correct water retention in the offgas system holdup line, potentially rendering both standby gas treatment trains inoperable, and failure to identify and correct significant fouling of a residual heat removal system heat exchanger.

Because this was not the first escalated enforcement action within 2 years, the staff considered whether credi; was warranted for /*ntification and Corrective Action. Credit was not warranted for identification because most of the violations were identified by the NRC. Although the licensee had already undertaken actiont to improvo its performance before the violations occurred, the licensee provided little information at the pre-decisional enforcement conference as to additional actions, timetables, etc., that would prevent recurrence of the violations er of other violations with similar causes Thus, corrective action credit could not be justified. This resulted in a double base civil penalty of $110,000.

It should be noted that the licensee has not been specifically informed of the enforcement action. The schedule of issuanco and notification is.

Mailing of Notice December 1,1997 Telephone Notification of Licensee December 1,1997 The State of Nebraska will be notified.

The licensee has thirty days from the date of the Notice in which to respond. Following NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed by Order.
